Chicago Ald. Jessie Fuentes has filed a federal claim against teh U.S.Department of Homeland Security following an incident where she was handcuffed by federal agents at Humboldt Health in the Humboldt Park neighborhood.The claim, filed Tuesday, initiates a process that could lead to a lawsuit alleging misconduct during the encounter.
The action stems from an event last month where Fuentes questioned federal agents about whether they possessed a warrant to arrest a patient inside the medical facility. The agents reportedly refused to answer her inquiry and afterward placed her in handcuffs. While Homeland Security maintains Fuentes was escorted from the area in handcuffs but not formally arrested, the alderwoman asserts the incident was a violation of her rights and has created a chilling effect on healthcare access within her ward.
Fuentes’ attorney stated the filing is an Administrative Claim required under the Federal Tort Claims Act, a necessary step before a potential lawsuit can be brought in federal court. The claim will be evaluated by Homeland Security, and if denied-or within six months-Fuentes intends to file a formal complaint.
The incident occurred amid reports of increased federal immigration enforcement in the chicago area and claims from healthcare institutions of significantly decreased patient attendance due to fears of deportation. Fuentes previously spoke publicly about the encounter, raising concerns about the impact of aggressive enforcement tactics on community health. Homeland Security, in a prior statement, said Fuentes was “free to go” after being removed from the area. The outcome of the federal claim will determine whether the matter proceeds to litigation.
