Captain Charged After Overloaded Boat Capsizes Near Liberty Island, Killing Mother and Baby

Prosecutors allege Manuel Hernandez, the 46-year-old who was operating a vessel that capsized in New York Harbor, was operating the boat illegally. The incident resulted in the deaths of a 27-year-old woman and her 5-month-old infant. The Department of Homeland Security said Hernandez is in the U.S. illegally.

The Fatal Incident Near Liberty Island

On the night of August 8, 2026, a 21-foot Yamaha motorboat carrying 14 passengers flipped over in the waters near Liberty Island. The incident occurred just before 10:30 p.m. The vessel, a bowrider, significantly exceeded its manufacturer-rated capacity of 10 passengers. The tragedy claimed the lives of Sara Sanchez and her daughter, Antonella Garcia, both residents of College Point, Queens. While 11 other passengers were rescued and transported to NYU Langone Hospital-Brooklyn in stable condition, the circumstances surrounding the charter operation have triggered a multi-agency investigation.

The Department of Homeland Security has identified Hernandez as being in the country illegally.

Criminal Charges and Regulatory Scrutiny

Following the accident, Manuel Hernandez was taken into custody and faces 13 counts of reckless endangerment. The investigation, involving the NYPD, the FDNY, and the U.S. Coast Guard, is currently examining whether the vessel was operating as an illegal charter. Coast Guard officials noted that such illicit operations often circumvent critical safety mandates, including the provision of adequate life-saving equipment and adherence to weight limits.

While toxicology reports conducted by the NYPD indicated no signs of impairment, the physical conditions of the harbor on that night remain a central focus. The area around Liberty Island, described by a source to nypost.com as the “Wild West” due to heavy debris, bridge abutments, and complex marine traffic, requires significant experience to navigate safely.

The Coast Guard continues to emphasize that legal charters must meet rigorous safety standards, a requirement that unlicensed operators frequently ignore.
