Brown Mogotsi Accused of Plotting Court Escape Disguised as Prison Official

Businessman and political fixer Brown Mogotsi planned to escape custody on August 20, 2026, by disguising himself as a correctional services officer to slip out of the Johannesburg Magistrate’s Court cells, according to the State. Prosecutors revealed the alleged escape plot during Mogotsi’s fourth bail application on Tuesday, August 25, 2026, presenting it as a central argument to keep him behind bars.

Mogotsi has been detained since his arrest in May 2026 following an incident in Vosloorus in November 2025. While Mogotsi initially claimed he survived an assassination attempt, prosecutors allege he actually fired 11 rounds into his own stationary, unoccupied vehicle. He currently faces charges of perjury, defeating or obstructing the ends of justice, unlawful possession of a firearm, unlawful possession of ammunition, and discharging a firearm in a public place.

Bail Arguments and Previous Court Proceedings

During the August 25 court session, the State opposed Mogotsi’s latest release bid by detailing the security breach attempt at the court cells. According to prosecutors, the planned disguise was intended to secure an undetected departure five days prior to the hearing.

Mogotsi’s defence team argued that the fourth application should be evaluated on its own merits, maintaining that it is founded on new facts. These new facts reportedly involve a fresh residential address provided to the court for potential release.

Previous bail bids by the North West businessman were denied, including an unsuccessful challenge in the Johannesburg High Court. Earlier hearings focused on concerns including flight risks, unreliable addresses, and allegations that Mogotsi attempted to intimidate witnesses and bribe an investigating officer. Prosecutors also noted that the firearm linked to the Vosloorus shooting has been connected to other serious crimes.

Witness Protections and Legal Timeline

The legal proceedings have previously addressed witness security. The court previously ordered the protection of names and addresses after prosecutors raised concerns regarding witness intimidation, citing an instance where Mogotsi’s wife allegedly visited a witness whose location had been disclosed in court.
