According to the New York Police Department, Manuel Hernandez was operating the 22-foot bowrider motorboat while it was carrying 14 people on board. Police subsequently arrested Hernandez, charging him with 13 counts of reckless endangerment. Federal authorities and local police are investigating whether the vessel was operating as an illegal charter.

Following the accident, a sightseeing vessel operated by Sea the City intervened. Adam Schwartz, representing the sightseeing company, noted that his crew took 12 survivors on board their hot tub boat, Sea the City II, before coordinating with the Coast Guard and NYPD Harbor units to bring them safely to land in Brooklyn.
