Austrian Court Bound by Higher Court Ruling – Implications for Defendant

The Linz Regional Court is bound by the legal assessment of the Upper Regional Court (OLG) of Linz, a principle underscored in a recent case concerning a defendant whose status remains undisclosed. The OLG Linz serves as the court of appeal for the regional courts of Upper Austria and Salzburg. Established in 1850, though briefly dissolved in 1854, and re-founded in 1939, the court currently operates from Gruberstraße 20 in Linz, sharing the building with the Upper Austrian Public Prosecutor’s Office.
