An Coimisiún Pleanála grants 3am weekend Letterkenny takeaway hours

An Coimisiún Pleanála grants 3am weekend Letterkenny takeaway hours

“This type of increase is not acceptable and will give rise to noise disturbance and unruly behaviour running into the early hours of the morning,” objector Bobby Singh said regarding a proposed late-night takeaway on Letterkenny Main Street.

An Coimisiún Pleanála has granted permission for a new takeaway on Letterkenny Main Street to open until 3:00 AM on Friday, Saturday, and Sunday nights, according to reporting by the Donegal Daily. The decision overturns tighter restrictions previously imposed by local government.

The application was submitted by Raul Kumar to change the use of a ground-floor retail unit into a takeaway, including associated signage and site works. Donegal County Council initially granted conditional permission for the premises to operate from 3:00 PM to 12:00 midnight Monday through Thursday, and from 3:00 PM to 1:30 AM on the remaining days.

Bobby Singh lodged a submission objecting to the hours with both the Council and subsequently with An Coimisiún Pleanála. Singh argued that residential properties in the area house families with children attempting to sleep. He stated that late-night customer arrivals and departures, car doors, loud conversations, and delivery drivers playing loud music would severely impact residents’ quality of life.

The objection also claimed that late-night takeaways become focal points for loitering after public houses close. Singh noted that the opportunity to buy food at that hour would prolong street activity, increasing the risk of anti-social behavior, littering, and food waste in nearby residential areas.

Dispute Over Competition and Public Order

During the planning commission proceedings, applicant Raul Kumar asserted that the appellant, Bobby Singh, owns a competing takeaway in the area. Kumar described the appeal as vexatious and designed to compromise his business operations.

An inspector’s report noted Kumar’s defense that several bars operate nearby, establishing the location as a vibrant hub where takeaway use is a historic occurrence. Kumar maintained that his establishment operates a litter collection policy regardless of source and reported no breaches of existing hours since December 2025.

Kumar also argued that takeaways on Lower Main Street are scarce due to recent closures. He suggested that extended hours would allow patrons to purchase food while arranging transport home, thereby increasing passive supervision and natural surveillance to help minimize anti-social behavior.

The Planning Commission Ruling

An Coimisiún Pleanála concluded that the development would not seriously injure residential amenities or property in the vicinity. The commission also found that the project would not endanger public safety through traffic hazards or impact public health.

Under the final determination, the operating hours are set between 5:00 PM and 1:00 AM from Monday to Thursday. Friday, Saturday, and Sunday operations are authorized to run from 5:00 PM until 3:00 AM.
