America’s 28.3 billion dollar market for impairing hemp products faces potential federal elimination after Congress voted to close a loophole in the 2018 farm bill.

Congress Targets the Hemp Loophole Behind Intoxicating Edibles and Beverages

Marijuana and hemp share the same cannabis plant family. While farmers historically cultivated low-THC hemp for sturdy fibers, food, or wellness items under the motto of rope, not dope, Kentucky Republican Senator Mitch McConnell pushed for industrial hemp legalization in the 2018 farm bill to provide agricultural producers with a new cash crop.

That legislation defined legal hemp as having less than 0.3 percent of delta-9 THC by weight. The threshold allowed manufacturers to produce beverages, snacks, and vape oils containing enough psychoactive compounds to cause impairment. Unregulated and untested products spread across gas stations and convenience stores nationwide, becoming accessible even to teenagers. Other sellers distributed raw marijuana under the designation of THC-A, which converts to impairing delta-9 when heated. These items undercut heavily taxed state-legal cannabis markets and evaded state-level recreational prohibitions.

Dozens of states enacted their own restrictions before Senator McConnell inserted a hemp THC ban into the measure that ended the longest government shutdown in history. The provision limits hemp products to 0.4 milligrams of THC per container.

Industry Operators Face Severe Revenue Losses and Facility Closures

A market study published by Whitney Economics last month calculated that the federal ban threatens to reduce retail revenues by 28.3 billion dollars, displace 225,000 jobs, and strip state governments of 2.1 billion dollars in potential sales tax revenue. Industry advocates and business owners are lobbying to preserve the market by restricting sales to adults aged 21 and older, capping total package potency, and banning imported cannabis compounds.

In Kentucky, Cornbread Hemp owners Eric Zipperle and Jim Higdon stated they are willing to cap products at 5 milligrams of THC to secure legislative compromise. However, they warned that the proposed 0.4-milligram limit would destroy their operation. The company employs 105 workers, distributes beverages across 18 states, and projects 65 million dollars in revenue this year.

In North Carolina, Deutermann Farms operator Nicholas Hohns spends his days mixing blue-green goo into gridded molds to manufacture potent THC gummies. Hohns entered the hemp sector after losing his personal trainer job during the COVID-19 pandemic. Although North Carolina has not legalized medical or recreational marijuana, the edibles produced at Deutermann Farms often exceed the potency found in states with legal recreational frameworks. Anticipating regulatory intervention, Hohns kept his capital investments minimal and is already evaluating alternative product lines, such as creatine gummies.

Other regional producers have taken more drastic measures. Drinkin’ Buds, a cannabis beverage manufacturer based in Sheboygan, Wisconsin, has halted production entirely, and co-founder Matt Swanson removed himself from the payroll.

Legislative Deadline Looms for December

Federal lawmakers face a December 11 deadline when the current funding legislation expires. Industry stakeholders continue to push for federal standards that balance age restrictions and package caps against total market eradication.
