Railway Customer Partially Wins Dispute Over Train Display Advertising
Bern, Switzerland – A railway customer is achieving a partial victory in a legal battle against Rhätische Bahn (RHB) over advertising displays on trains, with the case now being transferred to the Federal Office of Transport (BAV) for review. The customer initially filed a complaint arguing the displays were disruptive,but the federal Administrative Court ruled the issue wasn’t a contestable decision – classifying it as a “real act” outside their direct jurisdiction.
The dispute centers on whether the advertising screens on RHB trains unduly impair travelers. While the court declined to directly rule on the matter, it has tasked the BAV, which oversees railway construction and operation, with investigating whether the displays are excessively intrusive. The customer will also receive a reimbursement of CHF 1,500 in legal costs advanced, though the outcome regarding the cost of the two lawsuits remains pending.
The court’s decision highlights the ongoing debate surrounding advertising in public spaces and the rights of passengers to a comfortable travel experience. The BAV’s review will determine if RHB’s current advertising practices comply with regulations regarding passenger well-being.
