Sydney, NSW – A legal battle is brewing in Sydney after David Birenbaum, the individual involved in a February incident at Cairo takeaway in Newtown, filed a defamation claim in the Federal Court on Tuesday, May 14, 2024. The claim names Cairo Takeaway, its owner Hesham El Masry, and staff member Talaat Yehia as respondents.
The lawsuit stems from an incident on February 18, 2024, where Birenbaum entered the enmore Road cafe wearing a Star of David cap. The cafe,known for its vocal support of palestinian causes,experienced a confrontation with Birenbaum,which was afterward filmed and widely circulated online. The incident sparked debate regarding freedom of expression, religious symbols, and the potential for provocation.
