Marsh & McLennan Agency Secures Partial Injunction Against Alliant Insurance Services in Client Solicitation Dispute

A New York federal court has issued a partial preliminary injunction against Alliant Insurance Services, restricting the brokerage and two former Marsh McLennan Agency (MMA) employees from actively soliciting their previous clients. The ruling stems from allegations of a coordinated effort to poach clients following the employees’ departure to Alliant.

The case,marsh & McLennan Agency LLC v. Alliant Insurance Services Inc., Andrew Oldenburg, Elizabeth McKinney, Kimberly Moore, and Danielle Black, was filed in Manhattan federal court in August.MMA alleges that Andrew Oldenburg orchestrated a departure of staff and clients from the Beaverton, Oregon office when he joined Alliant in july.
MMA claims the departures resulted in the loss of 14 clients and approximately $600,000 in revenue, attributing this loss to breaches of restrictive covenants and non-solicitation agreements signed by the former employees.
Scope of the Injunction
The court’s injunction specifically targets Alliant, along with Andrew Oldenburg and Elizabeth McKinney, preventing them from soliciting former MMA clients. However, the injunction does not extend to the servicing of clients who have already transitioned their business to Alliant. Furthermore, it excludes two other former MMA employees, Kimberly Moore and Danielle Black, from the restrictions.
The court determined that MMA did not provide sufficient evidence demonstrating that Moore and Black were directly involved in servicing former MMA clients.
