Yarden policy still has to fully reimburse funeral arrangements | Money

According to Vereniging Sociale Verhaal, which came to the aid of the nineteen in the proceedings against Yarden, the way is open for large-scale proceedings against the insurer.

The nineteen holders of the package in kind policy are entitled to their original parts from this package for a complete funeral or cremation.

In the middle of last year, Yarden informed the 390,000 customers with this policy that it would no longer be able to meet the originally promised obligations from 1 January this year, although customers had paid premiums for this.

The package that Yarden offered meant that the next of kin of the insured received a limited package for the cremation or funeral. The remainder of the funeral was for his own account.

The Consumers’ Association immediately lodged an objection. Yarden referred to a separate rule in the policy called the en-block clause. This allows insurers to suddenly adjust the conditions for a large group.

Complaints institute for the financial sector Kifid recently supported the insurer in maximizing that package: Yarden was allowed to invoke the clause in the policy.

The nineteen Yarden customers who did not agree with this, heard from the judge this week that this argument is specifically incorrect for the nature package policy. This type of policy is intended to protect consumers against additional payments.

Yarden’s financial problems were caused by his own actions, the judge said. “That can only be blamed on Yarden.”

In a response to the ANP, the Consumentenbond Claimservice says that the verdict applies to all 390,000 policyholders.

The funeral insurance company has posted a reaction on its site: “Yarden regrets the ruling.” It allows for further study of the verdict. Yarden may be looking legally higher in the long-term issue.
