Workers Threaten to Sue Giant If Severance Pay Is In Accordance With The Copyright Act

The Confederation of Indonesian Trade Unions (KSPI) has threatened to fight back if the management of PT Hero Supermarket Tbk pays severance pay Giant employees who got hit PHK using the mechanism of Copyright Law (Ciptaker Law).

KSPI President Said Iqbal said the resistance would be pursued either through legal channels, mass action to the international level.

“Giant’s management should not take a stance that complicates the problem. If they do so, KSPI, ASPEK Indonesia and the Hero Supermarket Workers Union (SPHS) will fight back both legally and in action and take this to the international level,” he said in a virtual press conference, Thursday. (3/6).

According to Iqbal, severance pay should use the mechanism of Law No. 13 of 2003 concerning Manpower in accordance with the Collective Labor Agreement (PKB) between companies and employees.

“On several occasions in the media, Giant’s management revealed severance payments through the Job Creation Act mechanism. If management takes that attitude, we strongly reject it,” he said.

He also conveyed that there was no clarity on the number of Giant employees who would be laid off and those who would be re-recruited to be employed in other Hero business units such as IKEA, Guardian and Hero Supermarket.

In fact, the schedule for closing all Giant outlets in Indonesia is getting closer. “There is no agreement regarding the certainty of the time and mechanism for the layoff of thousands of Giant workers in the July 2021 plan,” he added.

The uncertainty also includes how the mechanism for re-hiring laid-off employees to be employed in other business units.

“Of course ASPEK, SPHS and KSPI do not agree that they have to re-register with the selection system. What we hope is that workers whose potential can be seen because they have worked for decades at Giant are immediately distributed without further testing and their tenure is not repeated from zero years,” he said.

Finally, Iqbal highlighted the issue of thousands of MSME workers who were threatened with losing their jobs due to the cessation of supply to Giant after the supermarket was closed.

“With the fall of the giant Giant, thousands of workers lost their jobs due to MSMEs, which were suppliers of perishable goods, along with the fall of the giant,” he said.

Because of that, he asked the government to help the MSME suppliers to Giant who lost their business while at the same time ensuring that workers affected by layoffs get their rights, such as severance pay, compensation, and final wages.

“The question is, where does the MSME industry pay for their workers’ rights? Because it is certain that Giant and Hero Group will not pay compensation or severance pay for MSME workers who have been laid off due to Giant’s closure. The government must be responsible for finding solutions for thousands of MSME workers who also participate. laid off,” he concluded.
