Summer time is garden time – and barbecue time. Smoke and the smell of barbecues often lead to conflicts with the neighbors. Neighbors should not be bothered by smoke or the smell of grilling. The Haus & Grund Grafschaft Moers association points this out in a message. The managing director of the owner organization, lawyer Michael Buser, explains: “If the neighbors feel bothered, barbecuing as an administrative offense can lead to a fine.”

He recommends trying to talk to someone in advance to avoid disputes. At the same time, Buser clears up a common misconception. “There is no clear regulation as to how many times a year barbecuing is allowed. Over the years, the case law has judged very differently what neighbors have to tolerate and what not.

Therefore, it is better to avoid litigation and ask how often grilling is okay for the neighbors. However, it is clearly regulated that the barbecue party after 10 p.m. must respect the neighbors’ night’s rest. Buser’s tip: “Anyone who maintains a good relationship with the neighbors and invites them to the barbecue party can elegantly circumvent the problem of noise or odor nuisance.”


In apartment buildings on the balcony or terrace, grilling is only possible with an electric grill. “A charcoal grill on the balcony is not allowed, if only because of the risk of fire,” adds the lawyer.


According to Buser, the electric grill is not a free pass: “Before the electric barbecue evening, you should take a look at the house rules and the rental agreement. Sometimes barbecuing on the balcony or in the garden is completely forbidden.” Due to the close proximity between the parties in the apartment building, it is ultimately unavoidable that the smell of barbecues will travel to the neighbors. “An infringement of the house rules can lead to a warning for tenants and, if repeated, to termination without notice,” the lawyer points out.
