Waldshut-Tiengen – In the period from July 1st to October 31st, 2022, all property owners must submit their declarations of assessment to the responsible tax office.

The current property tax law with its age-old property values ​​violates the constitution. The law must be compatible with the constitution by January 1, 2025 at the latest, otherwise it will become ineffective, according to the Federal Constitutional Court.

For the new law, all property owners in Germany must submit a declaration of determination. In Baden-Württemberg, the main factors are the size of the property and the land value (reference date: January 1, 2022). The soil assessment is the responsibility of the respective expert committees that have been set up specifically for this purpose. Taxpayers can query the land values ​​of their properties on the Internet (Bodenrichtwerte.de) or by direct inquiry to the expert committee.

The declaration must be submitted separately for each property. The addressee of the declaration is the tax office in whose district the property is located. If you have property in different federal states, you have to observe the different requirements of the respective federal state.

The declaration must be submitted electronically and authenticated. The free tax program ELSTER (electronic tax return) can be used for this. If you are not yet registered there, you can apply to set up such an account on the ELSTER website. However, it may take up to three weeks for the access data for registration to be sent. It takes place in a two-stage system via e-mail and letter.

Only people who do not have their own Internet access and who do not have the opportunity to use the access of relatives (children!) or friends may apply to the tax office for the official forms to be sent in paper form and submit the completed declaration in writing. Recommendation: submit as early as possible. Above all, the declaration period is far too short. Almost two of the four months fall into the summer holidays. “In many cases, neither the electronics nor the land values ​​will be available in time,” says attorney Anton Bernhard Hilbert, chairman of Haus & Grund Hochrhein e. V., fixed. This already shortens the deadline: “No explanation without a standard land value!” says Hilbert. He expects that there will also be problems with the mass procedures. The Chairman recommended that the declaration be made as early as possible. He expects a wave of extension requests shortly before the end of the declaration period.
