Verkehr – Darmstadt – No independence for driving instructors without driving school license – economy

Darmstadt (dpa / lhe) – Driving instructors are not able to work freelance without a driving school license. This is not the case even if they use their own vehicles and bear their operating costs, said the Hessian State Social Court on Thursday in Darmstadt. The judgment results from the driving instructor law (Az. L 1 BA 15/18). These teachers are dependent employees.

In the specific case, a driving school teacher from the Main-Kinzig district had sued who had registered a trade and worked with his own vehicles at several driving schools. He considered himself a self-employed person and applied for the corresponding status with the pension insurance. The insurance company rejected this on the grounds that the driving instructor could in principle not work independently due to the lack of a driving school license. The court followed this view. The driving instructor was employed at the respective driving school, it said in the reasoning.
