UOKiK will investigate payment backlogs and punish the guilty

“Puls Biznesu” wrote today that the president of UOKiK checks several dozen companies suspected of generating payment bottlenecks. There can be severe financial penalties.

As the newspaper emphasizes, the government seriously threw gloves on those who delay their payments to their contractors. Especially small entrepreneurs.

The law on combating payment backlogs has been in force since January 1, 2020 and is already used as a whip for unreliable debtors. On its basis, the president of the Office of Competition and Consumer Protection (UOKiK) has so far initiated 51 proceedings against companies whose accumulated overdue debt (more than 60 days) exceeds PLN 5 million over the next three months. By the end of the year, the head of UOKiK intends to initiate another 100 proceedings, reports “PB”.

According to the newspaper, only after these proceedings are completed, decisions will be made as to whether, who will be punished and in what amount.

The journal indicates that the act does not limit the amount of possible fines. The amount of the fine is to be calculated by the President of UOKiK according to a special formula, taking into account e.g. the amount of accumulated overdue debt and the length of the delay in payment.

“These provisions will definitely improve the financial liquidity of entrepreneurs,” said Tomasz Chróstny, quoted in “PB” by UOKiK. He added that “he means mainly medium, small and micro companies, to which larger contractors do not pay on time. As a result, smaller entrepreneurs credit the activities of economic tycoons”.
