Unscrupulous act or act in affect ?: Lawyer cannot recognize remorse in the accused – Canton (Solothurn) – Solothurn

The positions on this second day of the trial could hardly be more different. Here the public prosecutor who describes Federico T. * as a murderer and demands a life sentence plus detention. There the defense attorney, who wants to make it credible that the accused did not act as a vengeful person, but rather lost control of his actions; she vehemently contradicts the accusation of murder and the intentional killing attempted several times and demands that her client be acquitted. The defense attorney yesterday called the public prosecutor’s request a “joke”.

Public prosecutor Ralph Müller describes the accused as a “pathologically jealous perpetrator” who “eliminated” and “literally executed” his victim with “extraordinary insidiousness and mercilessness” possessed by a “real will to destroy”. Müller’s approximately 90-minute plea is characterized by repetitions; several times he uses the terms “insidious”, “primitive”, “perfidious” or “unscrupulous”. He paints the picture of a man with extremely problematic relationship behavior who locked up his girlfriend, harassed her and threatened her with death via Facebook after the breakup.

Despair led to ruin

It sounds different in the pleading of the defenders Sabrina Weisskopf. Federico T. had the gun with him because he wanted to take his own life. Instead, his desperation led to action in affect. In the affect because T. had not made any preparations and could hardly remember any details afterwards. According to Mirsad B’s * utterance, who had said to him in “glee” over a beer that he would go to the birthday party of T’s ex-girlfriend’s best colleague in the evening (see article from yesterday), the accused had “hung up”. The fact that he went to Mirsad B’s apartment was not planned, and he certainly did not want to kill B. or anyone else there.

For the public prosecutor, on the other hand, it is clear that the frustration of relationships that had built up over months discharged on this fateful 4th of July 2016. T. had shown a “perfidious insidiousness” by waiting briefly in “cheerfulness” and then following Mirsad B. to his apartment. Motive: Vengeance due to B.’s alleged silence regarding the whereabouts of Helena M. *, T.’s still dearly loved ex-girlfriend.

The defense sees it differently, of course. At the time of the crime, T. had suicide notes in his pocket, which indicated suicide, not murder. Nonetheless, there was a “short-circuit act” (quote from the defense), which cost the life of an uninvolved person, the father of a then 14-year-old son. Sabrina Weisskopf does not deny that her mandate is to blame for the tragic death of the victim, Federico T. is aware of the responsibility.

Victim attorney does not recognize remorse

Lawyer Burim Imeri, who represents the victims’ family and their civil claims, is concerned in his plea: “It is unbelievable that a completely uninvolved person had to die”. The loss of the father is also so difficult because the mother died early and the only son was still a minor. Imeri advocates a guilty verdict as charged and appropriate punishment.

For the son of the victim, he demands a satisfaction of 40,000 francs, for the father and the two sisters of the victim 30,000 francs each. During the pleading of the victim’s lawyer, the accused repeatedly tears. The way he crouches on his chair like a pile of misery does not indicate the repugnance of a murderer. However, he cannot expect pity or even understanding from the victim family. Lawyer Burim Imeri: “In letters to the family, the accused asked for forgiveness. But he does not really stand by what he did and portrays the killing as an accident. There is no real remorse to be seen. “

The defense already formulated an attempt at apology and a condolence in the plea. At the end of the trial, Sabrina Weisskopf once again affirmed Federico T’s regret, and the accused himself also spoke up and said quietly: “My soul has been destroyed. From morning to night I only think of the victim’s family. I am ashamed to look you all in the eye. “

The verdict is expected in early November.
