Understanding Working Hour Legislation for Employers and Employees

As an employer, you must apply the rules laid down by the legislation on working hours within your company. If you do not respect the maximum working hours, the employee suffers damage that you will have to repair.

The legal effective working time of a full-time employee is set at:

  • 35 hours per week;
  • 151.67 hours per month;
  • 1607 hours per year.

This duration applies to your company, whatever its form and number of employees.

Unless otherwise agreed, working hours are counted over the calendar week, from 00:00 Monday to 24:00 Sunday.

However, keep in mind that this is neither a minimum nor a maximum because conventional provisions may well provide that the working time within your company is less than 35 hours, or even higher.

The legal (or contractual) duration serves as a threshold for triggering overtime.

If the working time of one of your employees is less than the legal or contractual duration, then he is part-time.
