The PS mayor of Rouen Nicolas Mayer-Rossignol and 19 other mayors of the Rouen Normandie metropolitan area announced on Friday February 12, 2021 their
“More serious concerns about the conditions of treatment of foreigners by the prefecture services” of the Seine-maritime.“The associations for the defense of migrants tell us that almost all requests for regularization do not succeed in Seine-maritime”, write these twenty elected representatives of the metropolitan majority“Socialists and citizens” “ in this letter dated Friday addressed to the prefect and a copy of which was sent to the press.
“Frontline workers”
“Workers on the front line during the health crisis, in particular nursing assistants and health professionals” are “Particularly concerned”, add these elected officials who ask“An urgent meeting” on the subject at the prefecture.
According to them, while a circular of November 28, 2012“Proposes regularization as soon as the children have been in school for at least three years, this rule does not seem to be applied in Seine-maritime”.
These elected officials also deplore that requests on paper are in “Many cases” returned to applicants, invited to send them electronically. “This measure effectively excludes many applicants and first of all the most precarious”, criticize the mayors. In addition“Between February and May 2020 the prefecture refused to register requests for residence permits on the grounds that they were not accompanied by a tax stamp of 50 euros. The Rouen Administrative Court (…) has constantly reaffirmed the illegal nature of these decisions ”, still say elected officials.
“Case-by-case study”
In a letter to the mayors dated Friday, the prefect of Normandy Pierre-André Durand ensures that his services “Have taken note of these cancellations and have applied the judgments of the administrative jurisdiction several months ago now”. The prefect recognizes that “Punctually, if the transmitted request turned out to be incomplete or without clarification of the legal basis of the requested residence permit, the file could not be investigated”. “Therefore the administration seized the applicant to invite him to complete his request”, underlines the prefect.
Each individual situation “Is the subject of a case-by-case study”, with examination of “exceptional circumstances”, also “From the point of view of private and family life” of the user on the basis of the circular of November 2012, known as“Circular Valls” which is implemented, assures the prefect. Regarding the dematerialization of procedures,“A complete file submitted by post has never been returned to the user by inviting him to re-submit a file electronically”, underlines Mr. Durand, stressing that “Only files deemed incomplete could not be investigated”.
