Ndid not take the tests of one of his patients to the laboratory, modifying the papers and returning them to him without actually being analyzed. The patient, at least initially, could not suspect anything, because the report was on the headed paper of the laboratory with the signature of the referring doctor. But it wasn’t like that. A doctor got into trouble for producing a false certificate relating to a histopathology exam. Yesterday, at the request of the accused, the judge granted the suspension of the proceedings with probation, a legal institution that provides for the extinction of the crime under certain conditions. In this case, the doctor will have to carry out public utility work for six months and compensate the patient and the three injured doctors.
The motive is not yet clear and not even among the courtrooms has it been understood why the falsification of a trivial examination, which would have established the extent of a possible lump in the breast. But for the doctor, GM, obviously it was not the case to have the material taken analyzed. For this he falsified the printed paper of the analysis laboratory, together with the signature of another doctor, misleading a third colleague to whom the patient showed the report. The woman, however, was not convinced. The truth emerged thanks to a further visit from a radiologist, who found oddities within the cards. So the deception came out.
The doctor’s defender says he is satisfied in any case: «We have compensated the patient – explains Marta Bono – and asked for a trial for my client. The procedural choice we have opted for is independent of the dynamics of the facts. On which, therefore, for consistency I will not enter into the merits. But the judge considered that all the objective and subjective conditions required by law for accessing it existed ».
The judge yesterday established a compensation of one thousand euros for both doctors and two thousand for the analysis laboratory. Both the doctors and the laboratory were assisted by the lawyer Luca Calabrò: «The judge’s decision reassures us – explains the lawyer – because it requires an economic and energy sacrifice to the accused. What is important is that such situations no longer occur: the compensation for doctors is little more than symbolic, but we have not embarked on the judicial path for a matter purely related to money “. As part of the probation, the accused will have to compensate the patient for 16,000 euros.
