TSE rejects the protection of a Dominican registered abroad who wanted to vote in the DR

The Superior Electoral Court (TSE) rejected an amparo action that a citizen filed against the Central Electoral Board (JCE) in claim to be included in the voters list of the Dominican territory.

The Electoral Court rejected the action for not verifying violation of the fundamental political-electoral rights of the plaintiff Sabrina Andújar Read, because as stated in the form number 2015-615-006568 certificate renewal with minor data changes, he voluntarily registered in Miami, Florida on February 10, 2015, recording it by stamping his signature on that form in the section intended for “authorized census signature”.

“There is no record in the file that, after said registration, the plaintiff had requested the Central Electoral Board (JCE) to change the registration to exercise suffrage in Dominican territory,” states the TSE in the ruling TSE689-2020.

The amparo action was filed by Andújar Read on June 25, 2020.

The Court established that, in accordance with the provisions of article 108 of law 15-19, the application for registration in the register of voters residing abroad “It will be voluntary and through the presentation of the identity card and electoral”, As found, determined in the case of the plaintiff.

The decision was adopted unanimously by the 5 judges who make up the court, Román Jaquez Liranzo, president, Rafaelina Peralta, Cristian Perdomo, Santiago Sosa and Ramón Arístides Madera.
