Next Sunday, February 6, we will not do any shopping, mostly the so-called points postage. And all thanks to the sealing of the trade law, which entered into force in February. Discounters and supermarkets will be closed again all Sundays, at least until another gate is found. Most chains have already announced that they will not open stores, it is still unknown what Lidl and Biedronka are up to. And small shops? “Every Sunday, every Sunday, I open my Frog for you” – you sing in the commercial.

– The fun in parcel lockers by large retail chains will finally end and normal compliance with the act on restricting trade on Sunday will begin – said the chairman of NSZZ “Solidarność” Piotr Duda in a recording published on social media and appealed to all employees, but also to citizens. – If they notice that shops or retail chains are open on Sunday, they should report these practices to the labor inspectorate. And these labor inspections should impose the highest fines in such cases, i.e. PLN 100,000 – said the chairman.

On February 1, 2022, the act sealing the trade ban entered into force. The changes were to shorten the procedure of opening stores on the so-called “post office”. After the changes, it will be possible to be a post office open on Sundays, but under certain conditions. Only shops that account for at least 40 percent of the postal activity will be able to open. monthly income from retail sales. The vast majority of stores will not meet this condition.

Online shopping or shop without a dealer

It is not known whether the networks will look for more ways to trade unlimited on Sundays. The chain representatives have announced that their stores will be closed on non-trading Sundays after the amendment enters into force Kaufland, Net and Carrefour. It is still unknown what he will do Lidl i Ladybird. Biedronka’s press office informed that the network “strictly complies with the applicable provisions of law, but as a rule we do not comment on the legislation.” Representatives of Lidl Poland speak in a similar vein. “Lidl Polska has been operating on the Polish market for many years, always acting in accordance with applicable regulations – by providing a new service, we will also adapt to new legal regulations in force from February 1, 2022.”

It is known that the online store will be open from February 6 on non-trading Sundays Auchan – a service in which products ordered on the store’s website are delivered directly to customers’ homes. From February 1, residents can use the service Gdansk, Gdynia, Sopot and Rumia. Products can be ordered on the website of the network. Thanks to special cars, even frozen food can be ordered.

There is also talk of sales automation, i.e. autonomous stores without service. What is an autonomous store? This is an outlet with goods but no sellers. You can enter there, for example, thanks to a special application, and pay without cash. Such stores can operate seven days a week. Shops are monitored.

The covid act allows for Sunday work in trade

There is also … partial automation. The chain of Browarek stores in Silesia has introduced loyalty cards and self-service checkouts that support cashless payments, and the whole thing does not require the work of the seller, only … security staff.

The provisions of the covid act circumvent the Sunday trading ban?

Here the so-called special covid act. As reported by the portal serwisoscihandlowe.pl, thanks to it, an employee (or an employed person) will be able to perform the so-called trade-related activities of “unloading, receiving and displaying essential goods”. It cannot deal in trade in the strict sense of the word, and therefore will not stand at the checkout and serve customers, but will still be useful in-store as an aid to the franchisee / owner. Because owners of small shops expect more customers and emphasize that they will need help from employees on Sundays.

Let us remind you that from the very beginning, the act on restricting trade on Sundays allowed stores to be opened when the owner was behind the counter. Thanks to this, for example, Żabka stores, which are mostly franchise outlets, can operate. The network has been reminded of this in the advertising campaign for several days.

What if the owner has several stores?

– Under the special covid act, franchisees may entrust employees or employees with the unloading, collection and display of certain goods on Sundays that do not fall on public holidays. The decision regarding the use of certain exemptions in the act belongs to the franchisees – Żabka’s press office reported.
