The Supreme Court rules in favor of a fixed weekly rest day in the Madrid taxi

The Supreme Court has ruled in favor of the mandatory taxi rest system in Madrid of one fixed day a week, as indicated in article 37 of the Municipal Ordinance regulating the taxi approved in 2012.

This is stated in a sentence, in which Chamber III of the Supreme Court has upheld the appeal of the Madrid City Council which challenged the cancellation by the Superior Court of Justice of Madrid of the mandatory rest.

The magistrates determine that it falls within the organizational powers of the municipal corporation as there is no higher-ranking rule that establishes a criterion that must be followed.

For this reason, it revokes the sentence of instance when considering that it lacks any proof to maintain that the workload is not identical on a Monday as on a Friday.

According to the First Final provision of Decree 35/2019, of April 9 of the Governing Council, which modifies the Regulation of Urban Public Transport Services in Tourism Cars approved by Decree 74/2005, of July 28, Municipalities must not only adapt their Ordinances to the Decree, but also those in force as opposed to said Decree.
