The post-COVID world of work, according to Discitus

Like every Thursday for some time, the firm Discitus organized a free weekly webinar focused on the world of work in the face of COVID-19. However, the singularity of the meeting which took place on April 8 lies in the targeted period, namely the post-coronavirus era.

Indeed, placed under the theme “The return to work post-COVID”, this meeting aimed to deal with the subjects of the vaccine, teleworking and the revision of working conditions with the hypothesis that the virus is behind us.

For this, Alain Vachon, trainer and consultant in organizational environment at Discitus, invited two experts: Sébastien Lorquet and Christian Paquette, both lawyers in labor and employment law.

Basically, and after a survey carried out at web speed, it turned out that the subject that most concerned the participants, many of whom were from the management and executive fields, is the vaccine. . “What if an employee refuses to be vaccinated without invoking a factor protected by human rights?” Can an employee refuse to report to work because his colleagues are not all vaccinated? Can a boss force his employees to be vaccinated before resuming face-to-face work? These are all legitimate questions that employers and employees alike are asking themselves.

On this last point, Sébastien Lorquet could not be clearer: “As of today, no law obliges a person to be vaccinated” and Christian Paquette to add: “There is no no case law to date on a compulsory vaccination policy for an employer in connection with Covid-19 ”.

However, this was one of the rare times when certainty had the upper hand in the explanations of the panelists, a large part of the information was in the order of speculation! And for good reason, in the field, the situation is constantly evolving and no projection into the future can be accurate. Proof of this, if there was one, is that on the same day this webinar took place, the Stay Home Order went into effect in Ontario.
