The Administrative Court of Cundinamarca ruled in second instance in favor of adults over 70 years of age who filed a guardianship with the aim of breaking down the restrictions implemented by the National Government for this population, in the framework of the coronavirus emergency.

It is important to note that the measure applies to the entire Colombian population over 70 years of age.

“The Chamber considers it appropriate to extend the effects of this judgment so that it applies to all adults over 70 years of age, inhabitants of the national territory,” in order to further guarantee the safeguarding of fundamental constitutional rights, not only of the people who resorted to the constitutional mechanism, but of those who failed to do so, despite the fact that they are on an equal footing with those, “says a court document.

According to the ruling, the decrees issued by the President of the Republic that indicated that older adults could do physical activities outdoors for less time than people between 18 and 69 years old, “did not have a legitimate, important, compelling constitutional justification. , adequate and necessary ”.

In other words, the fundamental rights to equality, non-discrimination and human dignity of the plaintiffs were violated, in their condition as people over 70 years of age.

In conclusion of the above, the guardianship ruling allows these people, making use of their independence and self-determination, They can decide, like those between 18 and 69 years old, the times that they consider prudent, to go out to develop physical activities and exercise outdoors. This without putting self-care measures aside.

‘Rebellion of the gray hair’

A group of 25 older adults filed a tutela action against the Government for the alleged discrimination against them, with respect to the measures decreed in the midst of the coronavirus crisis.

The guardianship sought to nullify resolutions 464 and 844 of 2020 of the Ministry of Health and decrees 749 and 847 of 2020.

Political personalities such as Humberto de la Calle and Clara López appear on the list of names of those who filed the guardianship.
