The long legal battle continues for the gardeners of Aubervilliers. After the lost appeal against the building permit for the Fort swimming pool, which will eliminate 4,000 m² of plots, the opponents have gone back to the front lines to save around 6,000 other m² threatened by the Grand Paris Express.

The hearing, which this time focused on the merits, took place on Monday before the Paris Administrative Court of Appeal. Rather than mentioning the projects themselves, the applicants chose to attack the local inter-municipal urban planning plan (PLUi) of Plaine Commune.

“We focused on the urbanization of allotment gardens,” summarizes their lawyer, Me Pierre Heddi. We raised the question of the compatibility of the PLUi with the master plan of the Île-de-France region, the Sdrif, which provides for the preservation of existing green spaces. The second point put forward by opponents concerns Sdrif’s objectives of increasing the surface area in green spaces to 10 m² per inhabitant. With currently an average of 1.4 m² per inhabitant, Aubervilliers is already a very poor student. The amputation of one hectare would not remedy the deficiency.
