A mother from Witków (Sępólno poviat) faces up to 5 years in prison for infanticide. Her mother-in-law may even spend the rest of her life behind bars.

Today (July 21), Błażej G., a partner of the accused Natalia G. testified in the District Court in Bydgoszcz.

I suspected Natalia was pregnant. I realized this in May, June. Before that, I asked her several times if she was pregnant. She said no. Finally she said that “I am about to give birth to triplets”. She wrote me on messenger not to laugh when I “start losing weight”. So she said. She was wearing a weight loss belt. When we had sex, we didn’t get undressed. The last time the day before “this whole thing.”

The judge asked the witness if he still did not know that his partner was pregnant. He replied that he still did not know she was pregnant.

Parents also asked earlier, they suspected but the accused still denied it. The couple have one more child, Amelia, born in 2018. He claimed that he found out about the fact that he would become a father when Natalia was five months pregnant.

That night, Błażej G. testified, the older child woke up. Father got up and prepared Amelia’s milk. At that time Natalia came out of the room, “all bloody”. Natalia was scared, she was trembling and blood was leaking from her legs. She was wearing shorts. She wanted a sanitary napkin so I went to the bathroom. I couldn’t find them. I was also a bit scared when I saw Natalia’s blood. I didn’t know what happened. I woke my mother up and asked her to look after Amelka.

Natalia left the room while I was preparing milk for Amelia. She went to the other room and I saw her taking out the sanitary napkins. She was stained with blood and clear slime. She sat in the bathroom for about 20 minutes. I could hear the water flowing into the tub and being flushed into the toilet. When she left, I said we were going to the hospital. She said she had her period and was not going anywhere.

Błażej – as he says – went to the hall to get his shoes: – I saw that the bathroom floor was freshly washed. In my opinion, Natalia was cleaning the floor. I took her to the hospital then. I pressed it. She still had a grudge against me that she had a profuse period and that she had to go to the hospital.

– Before I left the house, I glanced at the room out of the corner of my eye, saw a smear on the floor, as if something had been washed away, smeared. We went to hospital. We left around 7 o’clock. We arrived at the hospital. I wanted to register Natalia, but she went to the bathroom first. She was in it for about 10 minutes. I wanted to register her, but she went down the hall in a different direction. I saw he was talking to someone on the phone. Then we finally went to registration. She hesitated, said she would go to her gynecologist, however. I left the hospital and after five minutes I came back, Natalia was standing in front of the registration window and just watching.

On the way back, the couple drove to a DIY store. – I wanted to buy screws because I was renovating the roof. Natalia was sitting in the car. At home, Natalia asked for car keys. I gave it to her and she left.

Błażej G. – as he says – entered the house. He took things out of the closet for Amelia to dress her up. It was the same closet in which the body of the newborn was later discoveredonly the shelf was on the other side. – I gave my mother things to change the baby. I went out into the yard.

– My brother, Jarosław, called me to help him with the renovation. I went to the store for building materials and returned home. I finished my coffee. And then Natalia texted me, do I want to have more children? She wrote to me that she had an ovarian tumor. I called Natalia but she didn’t answer. I drove towards my in-laws’ house, on the way we passed Natalia. It didn’t stop because there was no room for it on the road. I saw that she was crying. I went to my mother-in-law. She went downstairs. I told her about the whole situation, about the hospital, about the tumor. She made me keep calling Natalia to get in touch with her. I asked my mother-in-law if Natalia was with her, but she said no.

When Natalia finally answered the phone, she said – as the witness says – that she was in the woods, on a dirt road. She sat there and cried. I saw him talking to someone on the phone. We returned home. She got out of the car and went into the bedroom.

– I went to see what’s up with the little one, with Amelia. I went to my mother-in-law again, because Natalia was supposed to take her to the hairdresser. It was around 11 o’clock, we had a coffee and went with my mother-in-law to the hairdresser. When I was in the market square in Kamień Krajeński, my mother called me. She said she strangled my baby. I asked if it was Amelia, she said no; “that about two”. I threw the phone. We drove straight to Witków. I got out of the car, ran straight to my room. I saw that the child was lying by the dresser wrapped in a sheet. Mom was standing in the corridor. She was scared. I walked over to the baby and started crying. I went out into the yard, started crying and screaming.

Then Brother Mariusz asked Błażej what had happened. The answer was: “She killed my child.”

– There was a mother, mother-in-law and Natalia in the bedroom. I asked if it was born dead or alive – said the witness. – She said dead. I took the phone from my brother Jarosław and called 112. I said that my partner gave birth to a child and she strangled it. I knew it was because the baby had a sheet around its neck. Mam told me later – when the police arrived – that she tried to resuscitate them.

The 31-year-old mother Natalia Z. under Art. 149 of the Criminal Code is accused of infanticide, which took place on July 20, 2019 in Witków, next to Kamień Krajeński, under Art. 149 of the Criminal Code, which says that “A mother who kills a child during childbirth under the influence of its course shall be punishable by imprisonment from 3 months to 5 years ”. Originally, the woman was charged under Art. 148 par. 1.stating that whoever kills a person is punishable by 8 years to life imprisonment. The change in the charges was influenced by the forensic-psychiatric-psychological opinion of the mother.

– The evidence that we obtained from expert psychiatrists and psychologists indicated the need to change the charges. It follows from this opinion that Natalia Z. committed a crime during childbirth, influenced by its course. Hence the change in the legal classification of the act – said Marcin Przytarski, district prosecutor in Tuchola.

The woman was therefore sane, but in a state of birth shock. Hence the lower term of imprisonment.
Child autopsy and additional genetic research allowed to determine the exact cause of death. The exact description of the act in the indictment says that the mother of the newborn baby strangled them with her own hands, using a sheet – wrapping them around your neck and tightening them.

“According to the accusation against Natalia Z. Wrapping the sheet around her neck, she torn it with her own hands, which resulted in the death of a newborn child, the cause of which was violent asphyxiation caused by aspiration of amniotic fluid into the lungs and mechanical pressure on the structure of the neck in the strangulation mechanism ”.

Barbara G., the mother of Natalia Z’s partner, is also accused of helping the murder. In her case, the prosecution also changed the charges. Previously, she was suspected of inciting the murder. Now she is accused of committing the crime of aiding homicide. The woman is charged with the charge under Art. 18 par. 3 of the CC in connection with Art. 148 par. 1 of the Polish Penal Code, which provides for a penalty from 8 years to life imprisonment. Additionally, Barbara G. was supposed to give false testimony during the preparatory proceedings. The penalty for a woman does not change – Barbara G. is threatening from 8 years to life imprisonment.

Let’s add that the 31-year-old was supposed to hide her pregnancy. As she explained to the prosecutor – she did not know she was pregnant. – These explanations are not covered by the collected evidence. We do not believe it, but whether the concealment of pregnancy actually took place will be subject to a court decision. Similarly – did Barbara G. know about it, who also denies knowing about the condition of Natalia Z. It is difficult to verify – explained the prosecutor Przytarski.
