The court rejects the confrontation between Luis Bárcenas and Mariano Rajoy

The court that judges the alleged box b of the PP has today rejected the confrontation between the former president of the PP Mariano Rajoy and the former treasurer Luis Bárcenas, as requested by the defense of the latter, to confront their versions about the existence of irregular financing in the formation.

The president of the Chamber, José Antonio Mora, explained at the beginning of the session that the confrontation is not allowed “as it is an exceptional diligence for the investigation phase and not for the plenary session.”

The magistrate has explained that this test that Bárcenas intended to sit face to face with Rajoy is not justified solely by the existence of possible contradictions and points out that this test is only contemplated if there is no other way to conform the evidence.

“It is up to the court to assess the credibility of their testimonies in conjunction with the rest of the evidence,” clarifies the magistrate. In this morning’s session, the court has responded to the previous questions raised on the first day of the hearing by the defenses and accusations.

On the other hand, it has admitted the evidence requested by Bárcenas to summon journalists Francisco Mercado and Eduardo Inda to testify as witnesses for having knowledge of the alleged existence of box B. The defense of the former treasurer alleged that Mercado, then a journalist for El País It would have a recording of the former treasurer Álvaro Lapuerta, recognizing the box by paying bonuses to leaders of the PP.

The president has refused to delimit the object of the process as requested by the defenses and the PP itself, who is on trial as civil liable. The defenses wanted the Chamber to limit the trial since the popular accusations claim crimes much more serious than or requested by the Anti-Corruption Prosecutor’s Office and the State Attorney’s Office.

The court has indicated that “none of the crimes that are the subject of the procedure can be suppressed.”

This Monday the trial for Box B of the Popular Party resumes with the declaration of the former treasurer as accused after the resolution of the previous questions. The content of his foreseeable statement has already been anticipated over the last few weeks after the letter he sent to the Anti-Corruption Prosecutor’s Office in which he offered to collaborate with the Justice.

A letter in which he stated that the former president of the Popular Party was aware of box B of his formation after the custodian of the accounts entered his office and informed him of that parallel accounting.

According to Bárcenas’ version, Rajoy shredded the former treasurer’s famous papers in “a destructive machine” without knowing that he kept a copy of those accounts in B: his famous papers.
