The chief architect of Sofia continues the battle in court for the demolition of an illegal building by Rumen Gaitanski next to “Iskar”

The Municipality of Sofia, through the Chief Architect of the Municipality of Sofia, appealed within the statutory period the decision of the Administrative Court-Sofia City, which leaves without consideration the appeal of the Chief Architect against the annulled order to remove an illegal building near the Iskar Dam.

A year ago, architect Zdravko Zdravkov ordered the illegal construction of Rumen Gaitanski in the State Hunting Farm “Iskar” to be removed. The battle continues in court.

Here is what was reported by the “Architecture and Town Planning” Department to the Metropolitan Municipality:

The information spread in some media that the Metropolitan Municipality is not continuing the cases against the illegal construction in the area of ​​”Avala”, the “Iskar” dam, does not correspond to the truth.

On April 12 of this year, the complaint was submitted through the ASSG to the Supreme Administrative Court. To date, the Metropolitan Municipality does not have data on the administration of the appeal and there is no ruling by the Supreme Administrative Court.
We remind you that in June of last year, the chief architect of the Metropolitan Municipality issued an order for the removal of an illegal site “Reinforced Concrete Monolithic Building”, located in a property with identifier 22472.7450.100 under the KKKR, Dolni Pasarel village, Avala locality, dam. Iskar”, TP “State Hunting Farm “Iskar”, Pancharevo region – SO. The order was appealed and by a decision of the ASSG in December 2021, it was canceled.
Parties to the case are: “Bio mining” JSC and “Southwest State Enterprise” DP – territorial division of the State Hunting Farm – “Iskar” as appellants and the chief architect of the Metropolitan Municipality as defendant. In the rendered court decision, it is explicitly stated that the defendant in the case is the chief architect of the Metropolitan Municipality. The decision was appealed with a cassation appeal by the chief architect of the Metropolitan Municipality before the Supreme Administrative Court.

In April of this year, the Administrative Court – Sofia – City issued a ruling on the case, leaving the cassation appeal without consideration. The court’s reasons state that the chief architect was not a party to the case. The statement contradicts the order of September 1, 2021 of the same court, by which the chief architect of the Metropolitan Municipality was constituted as the defendant in the case, as well as the court records. This decision of the court is appealed, as we indicate above.

The Chief Architect of the Metropolitan Municipality is the defendant in all cases against his orders to remove illegal constructions. All cassation appeals filed by him as a party are accepted as admissible by the Supreme Administrative Court.
