The Italian Antitrust Authority has issued a sanction against Telepass for a misleading commercial practice involving insurance policies Rc Auto, distributed through its app for customers with Telepass Famly and Telepass Viacard subscriptions. According to Agcm, adequate information on the processing of user data and on the methods and criteria for selecting estimates would not have been provided.
The two companies Telepass and Telepass Broker were reported to the Antitrust Authority by theAnapa, the National Association of Professional Insurance Agents, because they would have shared the information of their users with insurance companies and intermediaries, concluding contracts for the distribution of policies without having adequately informed them about the methods of data collection and their use, including for purposes commercial.
Because Telepass illegally used customer data according to Agcm
On the section of the service provided by Telepass, the company limited itself to promoting the simplicity, speed and convenience of making a quote for car insurance through the application or website, but did not explain that the data was collected and used for purpose commercial diverse.
Furthermore, the customers of Telepass and Telepass Broker had not received one specific informative on the effective representativeness of the suppliers of the policies. The companies had limited themselves to reporting on the app and on the site the logos of the partners, without however clarifying that some were only intermediaries and that they acted as agents agent of third party companies.
According to what has been made known by the Italian Antitrust Authority, no information has even been provided on the criteria and on the parameters followed for the selection of the price quotation proposed, necessary for an informed choice by consumers.
Agcm’s decision against Telepass: pecuniary administrative sanction
Because of the commercial maneuvers on insurance Rc Auto deemed incorrect even after the opinions of the Authority for Guarantees in Communications and the Institute for the Supervision of Insurance, Agcm decided to fine the two companies. Telepass and Telepass Broker, which received a fine of 2 million euros which must be paid within 30 days of notification of the provision, issued on 18 March.
