Columbus Rape ‌Case Dismissed: Judge Cites Decades of Police⁤ Inaction

COLUMBUS, OH – A 1994 rape ‌case in Columbus has been dismissed after a Franklin County judge found ​that police failed to adequately investigate the crime for nearly three decades, violating the legal standard of “reasonable diligence.” The suspect, identified in June 2024⁤ through⁤ genetic genealogy after an⁢ initial “John Doe” indictment in 2013, will not be prosecuted.

Judge david Brown ruled that while the initial‌ indictment was filed ⁤within​ the statute ⁤of limitations, ‍the “minimal efforts” made by Columbus police detectives between 1994 and 2024 were insufficient. The decision, detailed in court ​documents, effectively ends the prosecution of⁤ the ​suspect, identified through DNA matching⁢ to evidence collected at the scene of the⁤ July 1994 assault.

“Though, the laws of Ohio and our separate Constitutions do not permit ‍a ‘crockpot’ approach​ to criminal investigations: ‍the government cannot ‘set it and forget‍ it,'” Brown wrote in his decision.

The case hinged on a DNA sample⁤ collected from a⁤ pillowcase ⁣following the assault reported by ⁢a 20-year-old woman. Court records indicate detectives also possessed facts regarding a potential suspect living in ⁢the ⁤area at the​ time,⁣ but no further investigative steps were taken.

Brown specifically noted that a simple neighborhood canvas “would have possibly closed⁣ the examination in ‍weeks not decades,” and that a DNA sample could have been obtained and matched in 1994, ⁣rather‍ than 2024.

Attorneys for⁣ the ​suspect had argued the prosecution‍ was ⁢barred by the statute of limitations. brown agreed that while the ⁤initial indictment ⁣was timely, the ‍prolonged lack of investigation undermined the case. ​He also highlighted the loss​ of three key witnesses who investigated the‌ case in 1994.

The Franklin County prosecutor’s office has the option to appeal Brown’s ​decision to the Tenth District Court⁣ of appeals.

Sheboygan Man Charged in Shooting Death of Canadian father, Bail Set at $2 Million

SHEBOYGAN ⁤FALLS, Wis. – A Sheboygan man has been charged with ‍first-degree‌ intentional homicide in connection ​with the‌ shooting death of Giovanni “Mike” Robinson, a 32-year-old Canadian man and father of a 6-week-old daughter. Bail was set at $2 million during a court appearance Monday.

According to a criminal complaint, authorities allege that Cruz Burgos, 30, shot Robinson following an encounter on Highway 23 near Sheboygan Falls on Wednesday evening. Burgos reportedly told investigators he made a U-turn and‌ drove past the group Robinson⁢ was ⁤with, but stated everything appeared‍ fine and he ⁤did not witness anyone firing upon them.

The ‌complaint details that ‌Burgos had previously⁢ been advised by a ⁣florida court in ⁣2019 that he could not obtain a firearm due to a domestic incident.He stated to investigators he no ⁤longer possessed any firearms.

Giovanni “Mike” Robinson, originally from Stouffville,​ ontario,⁢ had been living‍ in Pennsylvania with his wife, Rachel, and their daughter, Farrah. He was⁣ described by family as a devoted father and family man. “He was⁢ a true family man,‍ always making sure to spend every ‍spare second that he could with⁤ them,” his cousin, Daniella Apostolakos, wrote on a GoFundMe page established to support Robinson’s family. “Even when he couldn’t be⁣ around physically, he ⁣would make sure he was there through‍ FaceTime… Nothing filled a room⁣ like his smile and swift wit.”

As of monday, the ⁢GoFundMe campaign had raised over $230,000 CDN (approximately $163,500 USD).

Robinson’s hockey career included playing for the Niagara‍ IceDogs from 2012 to ‌2014 and five seasons at the University of Ontario Institute of Technology, concluding with a year of professional‍ play in Europe.

“We are heartbroken for Mike and his family,” said niagara IceDogs owner Darren DeDobbelaer⁢ in a statement. “This is a senseless ​act of violence… Once an IceDog,​ always an IceDog.”

Cruz Burgos is scheduled ⁣for a preliminary hearing in the case.

SHELBY TOWNSHIP, Mich. – A ​25-year-old Utica man is facing a first-degree murder charge after allegedly stabbing his estranged wife to death Sunday at⁢ a gas station in shelby Township.The incident occurred during a ⁢child custody exchange, authorities said.

Sidney Emmanuel Davis Jr. was arraigned​ Wednesday in⁤ 41A District Court, according to Macomb County Prosecutor⁤ Peter J.Lucido.Davis is ⁢accused‌ of fatally stabbing Fatme Davis, ​23, ⁤at ​approximately 5 p.m. at a Meijer gas station located at 15031 Hall Road.

police say the couple’s child⁢ was ‍present in the mother’s car during the attack ‍and ‍is now ⁣with the paternal grandmother. Authorities allege davis repeatedly beat‌ and stabbed ‍Fatme Davis inside the gas station. First responders⁢ transported her to a ‍hospital, where she later died from her⁢ injuries.

“The allegations in this case are both shocking and ‍deeply ⁢disturbing,” ‌Lucido said in a press release. “A young mother was allegedly‌ killed⁣ at ​the hands of her estranged⁤ husband, while their child sat waiting in the car. Our office is committed to pursuing this case to the​ fullest extent of the law to⁣ ensure justice is served.”

Davis initially fled the scene but ‍was apprehended ​by Macomb County Sheriff’s deputies in Armada Township. He was treated for a severe cut to his hand at a hospital before being taken into custody.

Judge Christopher Alayan denied ⁤Davis bond and scheduled a probable cause conference for ‍1 p.m. on Oct. 7. If convicted, Davis faces life in prison ⁢without the possibility of parole.

Pratt’s sentencing is scheduled for november 24.

Newark Man Sentenced to 11 Years for Assault, Kidnapping

Newark Man Sentenced⁢ to Over⁤ 11 Years for Violent Crimes Against ​Girlfriend

newark, OH – A Licking‌ County man has been sentenced to 11 to 16 years in ⁣prison for ​a⁤ series of assaults, strangulations, and ⁢a ‍kidnapping committed against his⁤ girlfriend over a two-month period. Dylan W. Hess, 32, of Newark, ⁢pleaded guilty to two counts ⁢each of felonious ⁤assault, kidnapping, and strangulation,‍ as well as one‍ count of intimidating a witness or​ victim, during⁤ a hearing ‌on ‍September 2, according to court records.

Judge David Branstool of the Licking County⁢ Common Pleas‌ Court ordered Hess to serve the sentence,​ with credit given for‍ 126 days‍ already served.

The ⁢Licking County Prosecutor’s Office‍ stated⁢ that Hess ‌repeatedly assaulted and strangled his girlfriend,with many incidents occurring in the presence of children. ​the assaults often involved the‌ use⁣ of a wooden stick,resulting ⁤in notable ​bruising to the victim’s body.

Hess was ⁤initially indicted by⁤ a licking County grand ​jury on April 2,with​ the crimes alleged to have taken place in March. He had previously posted‍ a $20,000 bail following an arrest in March on a drug charge and a warrant related to a prior domestic case.

Concerns regarding Hess’s behaviour ⁣were raised by his⁤ probation officer on April ⁤25, and by a⁢ victim’s advocate with⁣ Licking Municipal Court.‌ According to a police‍ complaint,the⁢ victim reported being picked up by Hess on April 27 and not‌ returned home after requesting ⁣it.She further alleged that Hess assaulted her ‍after⁢ she attempted to seek help, and detectives observed multiple injuries on the victim.

A superseding⁣ indictment adding the kidnapping ​charges was delivered ‌by​ a ‍grand jury in May. Hess⁤ initially entered a plea of not guilty before reaching a plea agreement ‍with ‌prosecutors.

in addition ‌to the prison sentence, Judge Branstool ordered Hess to serve ‌two years of probation, with ⁣the possibility of up to five additional years if he violates the ⁣terms⁣ of his release. Court records also indicate Hess was found ​guilty of domestic violence​ involving the same victim in Licking​ County⁢ Municipal Court in august.
