Suspect tells his lawyer what allegedly happened in his apartment
How exactly did 13 year old Leonie die? And what happened in the hours before she died? In June the girl leaned dead against a tree in Vienna. Before that, she is said to have been in the 18-year-old suspect’s apartment. RTL reporter Natascha Großer spoke to the young man’s lawyer. Dr. Thomas Nirk (67) met his client for the first time on Wednesday in the Josefstadt prison. The lawyer thinks the 18-year-old is credible.
The suspect is currently in custody. He and three other suspects are being investigated on suspicion of rape, resulting in death and abuse. He came to Austria from Afghanistan in 2015. There he went to school for the first time and then worked as an assistant cook, as the lawyer reports. In the following interview, the lawyer explains how the evening of Leonie’s death should have passed from the suspect’s point of view.

When did you meet your client for the first time and what did he tell you about the dramatic night?
I saw him for the first time on Wednesday. For my review, the core was whether or not there was rape and whether the girl was killed in the apartment. Did you put it outside and put it down or did you help? And has she at least lived in such a way that, according to the information given to him, the paramedic did not have the assumption that a person is dead here, but that help is still possible here. After a witness confirmed exactly this situation, as described by the client, it turns out that Leonie must have been alive at this point in time.
What really happened to Leonie?
That is the question that can only be answered after all evidence is available. Until then, any guesswork is pure speculation.
Which details of this evening or this night do you know?
Leonie was brought from Tulln to Vienna by a good friend who was her chauffeur that evening. He later asked her whether he should take her back with him. And she replied to him by SMS: “No, I’ll stay with my friends”
In Vienna, people set up flowers and candles for the dead 13-year-old.

How did it come about later that Leonie came to your client’s apartment?
They were all on the street. I know SMS traffic there. The young people wanted to chill out together in my client’s apartment. Leonie was not left helpless here to the arbitrariness of other men. She got the offer to go back and turned it down. With the sentence: “I go with my friends”.
What can be deduced from the SMS traffic overall?
That she wasn’t forcibly dragged into a dark apartment and raped. She went into the apartment of her own free will. As her best friend had confirmed.
What does Leonie’s best friend say?
She can understand very well that Leonie wanted to go to Vienna on her own that Friday. Vienna had fascinated Leonie. She loved going through the night and then spending the night with a friend if necessary.
How did it come to sex with supposedly several men?
My client was asked if he had drugs. Sex didn’t happen right away. First, Leonie cuddled with Zubai (22) and Ramish (16). Only then did sex come about. There was consensual sex – first with the Zubai and then with the Ramish.
My client watched it. It was probably a kick for him. It’s not what he said. It may be an explanation. He was holding Leonie’s hand. Ramish then forcibly pulled my client’s hand away from Leonie. My client denies having anything to do with drugs. How and where Leonie came into contact with drugs that evening is still unclear to me.
How can you tell if the sex was consensual or if it was rape?
You can tell from the penetration marks whether someone has been raped or not. […] But there is still no autopsy report.
How did it come about that Leonie supposedly had 11 tablets of ecstasy in her body?
From my current point of view, she can only have consumed it beforehand. But that can also be determined. It is also possible that Ramish and Zubai still had drugs with them.

Did the three young men discard the body later or not?
She lived when Zubai and Ramish took Leonie outside. My client describes that he had already done everything in the apartment to make her feel better. He gave her yogurt and honey. After about half an hour my client went out into the street and found the two men with Leonie. In any case, they sat Leonie on a tree in front of the house and my client called the rescue.
Under the guidance of the paramedic there, they attempted resuscitation such as chest compressions. A witness who hurried up described exactly this situation in her testimony. A young person on the phone is doing chest compressions on a person leaning against a tree. Leonie vomited while she was still alive on the tree.
Why didn’t your client call the ambulance straight away when he noticed that she was feeling bad?
My client took this guilt on himself and now regrets that he did not call for the rescue right away. That’s what worries him now.
As a lawyer, how do you rate this case after the initial interviews?
In my opinion, the focus should be on puberty and the associated irrational behavior of everyone involved. To accuse Leonie’s poor parents that they did not fulfill their duty of care is just as wrong as the information that Leonie was simply raped, killed and then put away like rubbish.
