South Jakarta District Court canceled the KPPU’s decision, Grab escaped a bill of rupiah in fines

KONTAN.CO.ID – JAKARTA. PT Solusi Transportasi Indonesia (Grab) and PT Transportation Technology Indonesia (TPI) escaped billions of rupiah fines from the Business Competition Supervisory Commission (KPPU). The South Jakarta District Court (PN) granted Grab and TPI’s objection to the KPPU’s decision.

Grab and TPI raised objections to the KPPU’s decision regarding special rental transportation services related to the provision of the Grab App software application operated by the Jabodetabek area (Jakarta, Bogor, Depok, Tangerang, and Bekasi), Makassar, Medan and Surabaya. This case is registered as number 13 / KPPU-I / 2019.

In its decision, the KPPU fined Grab of Rp. 7.5 billion for violating Article 14 and Rp. 22.5 billion for Article 19 (d) of Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. Meanwhile, TPI was subject to a fine of Rp. 4 billion and Rp. 15 billion for the two articles.

After the verdict, Grab filed an objection to the South Jakarta District Court. Well, Friday (25/9), the South Jakarta District Court scheduled a verdict hearing and decided to grant the objection from Grab and PT Teknologi Penggawai Indonesia (TPI).

Attorney for Grab and TPI, Hotman Paris Hutapea, said the South Jakarta District Court won Grab and TPI against KPPU. So the KPPU decision was canceled by the South Jakarta District Court. Previously, Grab and TPI were convicted by KPPU and paid a total fine of IDR 49 billion.

“All the decisions were overturned by PN Jakarta Selatan,” said Hotman on his Instagram page, Friday (25/9).

Meanwhile, KPPU does not want to provide further statements regarding this decision. KPPU will study the decision.

“Yes. Grab’s request was granted. But I don’t have the details (copy of the verdict) so I can’t give any further comments, “said the Head of the Public Relations and Cooperation Bureau of KPPU Deswin Nur, when confirmed, Friday (25/9).
