Sławomir Nowak remains in custody, the court dismissed the defense’s appeal

Former Transport Minister Sławomir Nowak will not be released from detention, the District Court in Warsaw decided on Tuesday. Nowak’s defense filed a complaint against the arrest at the end of July. The court also upheld the lower court’s decision on the other detainees in the case, Dariusz Z. and Jacek P.

On Tuesday, the Warsaw District Court examined the complaints against preventive measures were taken on July 22 against three detainees. The court did not admit the appeals against the decisions in the case of Jacek P., Dariusz Z. and Sławomir Nowak. – The court upheld the decision of the district court and shared the arguments of this court. At the moment, our client is in custody – said Nowak’s defender, Antoni Kania-Sieniawski in an interview with journalists.

As he added, the court argued this, among other things, with the fear of fraud and a severe punishment for Nowak. He stressed that the defense had applied for non-custodial preventive measures, such as a personal bail, property bail, ban on leaving the country or police surveillance. – There were 17 guarantees of trustworthy people from the world of science, politics and culture – he said. – We believe in the innocence of our client and we will do everything we can – emphasized the lawyer.

Sławomir Nowak detained

Sławomir Nowak was arrested by the Central Anti-Corruption Bureau on July 20 on suspicion of corruption, management of an organized criminal group and money laundering. Together with him, two people were arrested in Poland: former commander of the Grom unit Dariusz Z. and businessman Jacek P. The charges against Nowak against the prosecutor’s office concern the period from October 2016 to September 2019, when he was the head of the Ukrainian road agency Ukrawtodor.

Dariusz Z. and Jacek P. were charged with participation in an organized criminal group, money laundering and accepting financial benefits.

Two days later, the court decided to arrest Nowak and P. for three months. Nowak’s lawyer, Antoni Kania-Sieniawski, announced that he had lodged a complaint against the arrest. In relation to Dariusz Z., a decision was made on conditional arrest. If he pays a million zlotys – he will be able to be released. On July 29, the prosecutor’s office filed a complaint with the District Court for Warsaw-Mokotów against the use of such bail.

The investigation is conducted simultaneously by the Central Anticorruption Bureau and the District Prosecutor’s Office in Warsaw, as well as the Special Anticorruption Prosecutor’s Office in Kiev and the National Anticorruption Bureau of Ukraine.

Prosecutor Jan Drelewski informed that the court also upheld the remaining decisions. – The court did not accept our complaint about the application of pre-trial detention against Colonel Dariusz Z., it did not accept the complaint of his lawyers, so the decision of the district court remains in force, i.e. the arrest will continue, and the colonel may convert it into detention measures if he pays specific bail bond – he said. As he added, in the case of the other suspects, i.e. Jacek P. and Sławomir Nowak, the court also upheld the challenged decisions of the lower court.

Pre-trial detention for Aleksander D. detained in the case of Sławomir Nowak

On August 5, a Warsaw court decided to apply a three-month detention to Aleksander D., who had been detained in the investigation against the former Minister of Transport Sławomir Nowak. The day before, Alexander D. heard the accusation of making him a promise to provide him with a material advantage of considerable value. It is about the amount of over PLN 700,000. The suspect did not confess to the alleged acts and refused to provide explanations.

According to Aleksandra Skrzyniarz, spokeswoman for the District Prosecutor’s Office, Aleksander D. represented a Polish company dealing with infrastructure project management from 2016 to 2018. The company was interested in providing services in Ukraine.

Former minister

Sławomir Nowak was a minister in Donald Tusk’s government in 2011-2013. Earlier, in 2007-2009, he was the head of Tusk’s cabinet and secretary of state in the prime minister’s office. As a result of problems with Polish law (he was accused of not showing a valuable watch in his property declarations, the court conditionally discontinued the case, finding Nowak guilty), he renounced his MP and left domestic politics. In 2016-19, he was the head of the Ukrainian road agency Ukrawtodor.
