The lawyer starts a so-called civil summary action against the government at the court in The Hague. “The hearing will be somewhere around December 15, so that the fireworks industry can still respond to the decision,” says De Jager.

Investments

The fireworks industry is especially annoyed by the late time when the fireworks ban was imposed. “The train was already in full swing when the government made the decision. Commitments have been entered into with importers and containers full of fireworks are on the way, arriving shortly at the port. Huge sums of money have been invested, while the turnover will soon be zero. In addition, there are problems with storage. A fireworks ban causes disproportionate damage, ”says De Jager.

The fireworks ban has been introduced to relieve worry. It is overloaded by the corona virus. The turn of the year is one of the busiest times for emergency care in hospitals. The lawyer of the fireworks industry thinks it will be not too bad this year, because the heavy fireworks have already been abolished.

The use of fireworks was already curtailed at the beginning of this year. Among other things, bangers, flares and fireworks from the heavier F3 category have been banned from 1 December. De Jager: “The fireworks sellers have every understanding and admiration for people in care and enforcement, but it seems that corona is being dragged along with the hair to declare a fireworks ban. Due to the abolition of the heavy fireworks, the tax on healthcare has been limited this year. ”

Compensation

The fireworks industry receives around 40 million euros in compensation from the cabinet, but the lawyer calls the compensation scheme unclear. “It is an allowance in transport and storage, but it is no use to my clients. They have no turnover. ”

The fireworks industry is warning of a shift to illegal fireworks and things like carbide shooting. “You hold your heart now that Westerners are taking carbide shooting courses. And with the current unrest among young people in Urk and Roosendaal, the question is whether a fireworks ban is really sensible. ”
