Reported for police violence – dropped

The surveillance camera captured the arrest of a 17-year-old boy and his 23-year-old brother in a garage at Stovner on November 10, 2020. The arrest took place after an incident of violence against a person where both boys were later convicted.

The video shows the brothers obeying the policeman’s message to lie down on the concrete floor.

While the 17-year-old boy stands on all fours, kicks the policeman him. The boy thought the kick hit him hard in the head. The policeman, who arrived at the scene alone, claims the kick hit him in the shoulder or arm.

According to the prosecution decision from the Special Unit for Police Affairs, the policeman must have perceived that the brothers spoke together in a language he did not understand.

He is then said to have aimed the kick at the 17-year-old to get his attention back.

The special unit believes that it has not been proven that the kick hit the head.

The boy has explained that the kick hit him on the left side of the head, close to the ear. According to the indictment, the boy should not have remembered that he was fired when he came out of custody, before his brother told him about it.

The results of the Bureau’s investigation showed that the police officer had not committed a criminal assault and the case has therefore been dropped.

Dagbladet has been in contact with the brothers who have just read the Bureau’s decision.

– We were put out. My brother feels let down by all parties. It was even documented with a picture of the injury to his head, says the eldest brother.

– He sits leaning forward on all fours and the kick hits right under the ear. When the video is angled from behind, it is difficult to see, he says.

The special unit criticizes the police officer for not reporting the dismissal in his incident report, but concludes that it is not in itself a criminal misconduct.

The eldest brother responds to this.

– The fact that he never reported it before we took the case further is also startling and we will look at the possibility of taking the case further.

– We will consider whether the suspension should be appealed to a higher prosecution body, says Petter Bonde, who is the youngest brother’s lawyer.

Dramatically

When Dagbladet met the brothers in September last year, the older brother said that they cooperated with the police during the arrest and followed all orders.

– When the kick happened, I lost all confidence in the police, the 23-year-old said.

The night the arrest took place, the two brothers drove to Stovner to confront a person who had beaten their father the day before. They found him sitting in the car in a parking garage.

A verdict from the Oslo District Court describes the violence the brothers committed against the man as gross. The man ended up sewing 16 stitches after being hit several times in the head with his fist and with a knuckle iron.

It was a dramatic scene that met the policeman who arrived alone. The victim must have been bloody in the face and both brothers must have had blood on their fists.

The 17-year-old was sentenced to 90 hours of community service. The older brother was sentenced to 120 days in prison and will soon be served with an anklet.

The police in Oslo refrained from answering questions in this case pending the result of the Bureau’s investigation when Dagbladet covered the case last year.

According to the communication department of the Oslo Police, the police do not want to comment on the decision and refer to the Bureau of Investigation.
