Prisoner fell into a coma, is now supposed to pay € 18,227 for it – Austria

While he was in the hospital with meningitis, a prisoner was released. Because he lost the insurance, he should pay now.

A horrific bill has now been presented to a Carinthian prisoner after he had been in the Klagenfurt Clinic for two months. The 21-year-old convicted of bodily harm and damage to property fell ill with meningitis in the summer. “His condition was very bad. He could not walk and could hardly speak,” said lawyer Philipp Tschernitz.

In the meantime, his client had completely stepped away, even fell into a coma. The prisoner was therefore declared incapable of detention and released from prison exactly one month after his admission to the hospital.

The expensive bill: 18,000 euros

The fatal consequence of this decision: The 21-year-old, who was previously insured through the judiciary, suddenly found himself without insurance cover – and is now sitting on 18,227 euros in treatment costs! For Tschernitz a blatant injustice. “You can’t detain someone who is not able to insure themselves and say see that you get ahead,” said the lawyer.

AMS does not want to pay either

He sees a loophole in the law, because ex-prisoners can normally be insured through the AMS. To do this, however, they have to be healthy. “The AMS does not feel responsible here because someone who is sick is not available for the job market,” says Tschernitz. The ÖGK and the judiciary would also block and declare that they had no control over the case.

The legal representative is now holding further discussions and is trying to find a goodwill solution. If this does not succeed, legal remedies are also conceivable. One has to consider, for example, whether the judiciary has not violated a duty of care with the sudden release from liability: “You should at least have advised my client.”
