Poultry Farmers Sue Minister of Agriculture for Rp36 Billion

Breeder Poultry represented by the Chairman of the Indonesian People’s Breeders Association (PPRN) Alvino Antonio sued the Minister of Agriculture Syahrul Yasin Limpo to the State Administrative Court (PTUN) Jakarta. It was filed at the loss of poultry farmers.

He sued Syahrul to pay material compensation of Rp. 16 billion and immaterial of Rp. 20 billion. He registered the lawsuit at the State Administrative Court (PTUN) with number 227/G/TF/2021/PTUN.JKT on Friday (24/9).

He filed the lawsuit because he considered that Syahrul had not carried out his duties, provided protection to independent farmers/breeders or the people properly.

In fact, according to him, the task has been stated in the Law (UU) of the Republic of Indonesia Number 19 of 2013 concerning the Protection and Empowerment of Farmers. Not carrying out his duties, he said, meant that Syahrul had committed an unlawful act.

In addition to the claim for compensation, in his petition, Alvino also asked the Court to instruct Syahrul to provide livestock production facilities and infrastructure as well as to take action and provide business certainty to farmers/breeders through guarantees on marketing of agricultural/breeder products.

Then, stabilize agricultural commodity prices, eliminate high-cost economic practices, compensate for crop failures due to extraordinary events, such as the COVID-19 pandemic.

Then, provide agricultural/livestock insurance when farmers experience losses due to low selling prices.

“The government is obliged to prioritize domestic agricultural production to meet national food needs through regulating imports of agricultural commodities in accordance with the harvest season and/or domestic consumption needs,” the petitum said as quoted on Monday (27/9).

On the other hand, he also demanded that Syahrul limit the import of brood chickens to avoid over suply live bird (live chicken). He said that this restrictive measure is to create commodity price stability, especially to keep prices from falling during the main harvest so that farmers/breeders can benefit.

He added that marketing guarantees are the right of farmers to earn profitable incomes. Guarantees can be provided through direct purchases, storage of farming results, and/or the provision of market access facilities.

In addition, Alvino also asked Syahrul to limit the import of broodstock/GPS according to the needs that have not been fulfilled by domestic production.

Then, giving equal treatment and market access between independent farmers and integrators in the GPS import quota facility.

Also implementing hedging of agricultural/livestock products as a business strategy to protect the value of agricultural/livestock product commodities from the risk of falling prices.

“Requires Defendant I (Ministry of Agriculture) and co-defendant to compensate all material losses suffered by the Plaintiffs amounting to Rp16 billion and immaterial in the amount of Rp20 billion,” he said.
