The responsible district administration has now started processing them. The district office of the Saale-Orla district confirmed this on Wednesday upon request.

According to this, 23 men and nine women between the ages of 17 and 73 are accused of having attended a prohibited gathering, which is an administrative offense according to Section 29 Paragraph 1 No. 1 of the Assembly Act. According to the district administration, those affected come “mainly from Pößneck and Krölpa, four people from other municipalities belonging to the district and two people from places outside the Saale-Orla district”.


At least three local politicians made things happen

All recorded participants in the elevator would have to answer, including the local politicians who walked with it and let things happen. The district administration did not want to give names. However, at least the Pößneck city councilors and district council members Manfred Bentz (AfD) and Wolfgang Kleindienst (Birso / UBV) as well as Weira Mayor Martin Jacob (AfD) were in the crowd.

The administrative offense reports should be processed “as quickly as possible”. “We are assuming a processing time of eight weeks,” said the district administration. This includes the time that the written hearing of those affected will take up.

Legal remedies are possible in the event of a fall

What realistic fine should the 32 men and women expect in the event of an accident? “Administrative offenses in accordance with Section 29, Paragraph 1, No. 1 of the Assembly Act are punished with a fine of up to 500 euros,” replied the district administration in writing.

Objections to a fine can be lodged within fourteen days. In such a case, the procedure goes to the Gera public prosecutor. If necessary, the Pößneck District Court will have to make a decision in the end.

Observers estimate that it is precisely the local politicians concerned who will allow a trial if they are to be fined. Immediately afterwards, participants in the illegal event presented themselves as victims of state violence.

Demo registrant has not taken any responsibility until today

Immediately after the forbidden demo, the district administration found that Wolfgang Kleindienst in particular had caused confusion, with misinterpretations of the legal situation in front of the camera. “The prohibition of a specific registered meeting does not require a general order,” says the district office, among other things. “In addition, a general decree does not have to be passed by the committees or by the district council.” A general ban on assembly for the Saale-Orla district has never been issued. The demo on December 14, 2020 in Pößneck was prohibited in the course of an administrative act and the applicant was notified. This decision was not contradicted.

Manfred Bentz had registered the demo that got out of hand. The AfD local politician has not taken responsibility for this to this day. “Conducting a prohibited meeting” is a criminal offense according to Section 26 of the Assembly Act.
