The second suspect in the “coal case” – Viktor Medvedchuk – has been under house arrest for more than a month. Focus talked to political experts to find out why the fifth president of Ukraine was given the mildest measure of restraint.

On January 19, the Pechersky District Court of Kiev elected the fifth President of Ukraine, Petro Poroshenko, a measure of restraint in the form of a personal obligation to proceed, under which politician suspected of treason due to the supply of coal from the territories of Donetsk and Luhansk regions not controlled by the Ukrainian government. The people’s deputy from the “European Solidarity” was obliged to surrender all passports and was forbidden to leave the territory of Kiev and the Kiev region. Also, by a court decision, all the property of Petro Poroshenko and his wife Marina was arrested.

It is noteworthy that the other suspect in the same proceedings, people’s deputy from the Opposition Platform for Life Viktor Medvedchuk, was placed under house arrest without the right to bail. Both politicians face up to 15 years in prison if found guilty. Focus decided to talk to political experts to find out why Poroshenko chose the softest of the existing preventive measures in Ukrainian legislation.

“Poroshenko was not going to plant”

Political scientist Volodymyr Fesenko is of the opinion that Bankovaya actually did not intend to send the former head of state to prison, since President Volodymyr Zelensky needs him as an opponent in the second round of the next presidential elections.

“This does not mean that there are no claims against Poroshenko. We decided to hush up the conflict amid the arrival of Western guests. They ask why we need it right now, so we decided to remove the problem as much as possible,” Fesenko notes.

Political analyst Petro Oleshchuk in a comment Focus also shares the opinion that Poroshenko was not going to be sent under house arrest or to a pre-trial detention center.

“Supporters escalated the situation, allegedly they definitely want to arrest him, and now they say that they won because they came out to support him. There is no evidence that the authorities had a goal to imprison Poroshenko. There was no need to make a hero-martyr out of Poroshenko. Therefore, arguments are being removed that the process is unfair, that this is political persecution,” says Petr Oleshchuk.

The purpose of Poroshenko’s suspicions of treason, the political analyst believes, was to “drag” him into the process so that he would listen to Medvedchuk’s testimony and that the whole country would observe their relationship every day. What does “personal commitment” mean for Petro Poroshenko?

Vladimir Fesenko in the comments Focus says that the preventive measure in the form of a personal obligation provides that Poroshenko will be forced to appear before the investigator upon request and not leave the Kiev region without the consent of law enforcement officers and the judge.

“This is not house arrest, but restriction of movement, Poroshenko will not be able to go abroad. He must hand over his passport for preservation – a document that gives the right to leave, “says Fesenko.

People’s Deputy of the European Solidarity faction Oleksiy Goncharenko published in social networks the court’s decision as Poroshenko was suppressed. According to the published document, the following obligations were imposed on the politician:

  • deposit documents for traveling abroad;
  • inform the investigation about the change of residence;
  • to arrive at each request to the pre-trial investigation body, to the investigator or to the court;
  • not to leave Kiev and the Kiev region without the permission of the investigator, prosecutor or judge.

Judging by the document, such restrictions are imposed on Poroshenko for two months, that is, until March 19.

“Now it’s not a trial or a sentence, it’s a preventive measure so that the suspect does not disappear from the country, does not interfere with the investigation. This is not the end of the story. Soon we will see the appeal, the prosecutor’s office will file“, Oleshchuk says.

The prosecution in the proceedings requested that Poroshenko be taken into custody with an alternative in the form of a bail of 1 billion hryvnias. The State Bureau of Investigation (SBI) has already announced that they intend to appeal against the decision of the Pechersky District Court of Kiev, made public on January 19, regarding the measure of restraint for the fifth president. However, the press service of the department stressed that the court ruling proves “the justification and legitimacy of the suspicion.”

A measure of restraint in the form of a personal obligation, says Fesenko Focus, will not prevent Poroshenko from continuing his political activities.

“If there were an arrest, it would be a reason to arrange a performance. To avoid this, they chose such a measure as mild as possible to show that no one is preventing Poroshenko from engaging in political activities,” Fesenko notes.

Opposition representatives, the political scientist argues, did not support Poroshenko, since his weakening is in their favor – it strengthens other camps.

The fact that the fifth president was left without the support of opponents of the authorities from other groups is also noted by Oleshchuk.

What will happen to Petro Poroshenko’s rating?

Political analyst Petro Oleshchuk doubts that support for Poroshenko will increase significantly due to suspicion of treason and the past trial with the election of a measure of restraint.

It is unlikely that the rating will go beyond the boundaries of the electoral niche – 24%. Here he can pick up breakaway voters. But what to consolidate around – I didn’t go to jail, the case will be long and tedious,” says Oleshchuk Focus.

A similar opinion is expressed by political scientist Vladimir Fesenko.

“Poroshenko may have an increase of 2-3% temporarily. Because of all the events, Poroshenko began to be supported by people who did not like Zelensky, but they did not support Poroshenko either. Now a situation has arisen that they came to the defense of Poroshenko as victims of persecution“, – says Fesenko.

Zelensky, the political scientist believes, will have a rating drop due to socio-political problems, and not because of the story with Poroshenko.
