The case concerns an inhabitant of the Czempiń commune, who went on a trip with his family and did not cover his mouth or nose. It was less than a month after the government regulation introduced an epidemic state across the country due to COVID-19 and many strict restrictions for citizens and businesses. The police wanted to punish the man with a fine, but he did not accept it.

The cyclist was called to the police, where he was charged with another charge – violation of the prohibition of movement. According to the officers, while riding a bicycle, he did not satisfy his vital needs.

Strong brings “RP”, judge Agnieszka Olszewska refused to initiate proceedings, citing freedom of movement under Art. 52 of the constitution, and in the matter of masks – on expressed in art. 31 the principle of proportionality of the restriction of rights and freedoms. To the question: “Due to the pandemic in the world, do you think that we should be obliged to cover our mouth and nose, that is, wear masks in closed rooms, such as shops?” the answer “definitely yes” was given by 53.4 percent. respondents. 30.9 percent of the respondents is rather yes. The opposite opinion is shared by 14 percent. people, of whom 5.8 percent say “definitely not”

The respondents were less unanimous when it comes to the amount of fines. Most of the respondents would like the fines to be not too excessive and to be in the range of PLN 50-100. This is what 24.5 percent want. 23.6 percent of respondents allowed slightly higher penalties – in the range of PLN 100-200. Only 8.4 percent. Poles are allowed to exceed the penalties 500 zł.
