The supreme prosecutor Pedro Chávarry Vallejos may be prosecuted for the alleged crime of real cover-up, ordered this Friday the Special Criminal Chamber of the Supreme Court Justice Power of attorney.
The decision revokes the judicial resolution issued by the supreme preparatory investigation judge Hugo Nuñez Julca, who declared the request of the Public ministry to prosecute the former prosecutor of the Nation for having removed prosecutors on December 31, 2018 Rafael Vela Beard and José Domingo Pérez of the Special Team for the case Car wash.
On February 25, the Special Criminal Chamber of the Supreme Court evaluated the request of the Prosecutor’s Office to declare unfounded the resolution that released in November Chávarry to be processed.
However, at that time a resolution was not reached due to the term enjoyed by the magistrates and, later, due to the arrival of the pandemic of coronavirus in Peru, which also paralyzed judicial activities in the national territory.
At the time, Judge Núñez Julca considered that the facts imputed to Chávarry – the removal of prosecutors Vela and Pérez – were not subsumed under the criminal type – real cover – outlined in the tax document.
This means that the magistrate of preparatory investigation pondered that the facts described by the request of the Public Ministry, did not fit into the crime of real cover-up.
