One Year Wait for Unconstitutional Divorce: High Court – Christian Divorce Kerala High Court | Manoram online

Kochi: The High Court said it is not acceptable that couples filing for mutual divorce have to wait a year. The court criticized the provision that couples would have to wait a year to file for divorce. The court was referring to marriages according to the Christian rite.

The obligation to wait one year after marriage for divorce by mutual consent is unconstitutional. The court also noted that the waiting clause is a violation of fundamental rights. The court said the family courts should not dismiss the application on this ground.

The High Court referral came during the hearing of a petition against the Family Court order rejecting the divorce application on the condition that the marriage had not been completed for a year. The High Court ordered the family court concerned to examine the application urgently and to dispose of the divorce application within two weeks.
