One in eight companies does not respect the obligation to telework

These companies are liable to a fine ranging from 200 to 2,000 euros.

DThe actions carried out by the inspection services to monitor compliance with the obligation to telework have revealed violations by 12% of employers, reports L’Echo Wednesday.

Controls relating to compliance with the teleworking obligation were carried out with 21,636 employers, including the self-employed, between December 2020 and April 25. These operations revealed infringements at 2,673 employers, or 12.3% of those checked.

Today, these offenders are exposed to administrative penalties ranging from 200 to 2,000 euros, but they could become more severe, reports the daily. The SPF Emploi is in fact working on a text aimed at modifying the social penal code in order to tighten them up.

It should also be noted that since April, employers are required to communicate to the ONSS how many of their workers cannot work remotely. In detail, 91% of employers with more than 50 workers were in order, while 76% were in order in companies with 5 to 50 people, and just 36% in companies with 1 to 4 workers.

“In very small companies, the results are indeed not great. These often do not know the rule and for the most part do not have a social secretariat able to support them, ”says the Dermagne cabinet, which is considering exemptions to adjust the system.
