A 73-year-old wants to enforce an early vaccination against the coronavirus by making an urgent application to the Administrative Court of Oldenburg. He is seriously ill.
The 73-year-old’s heart is only 22 percent efficient, as reported by NDR 1 Lower Saxony. According to his own statements, doctors have confirmed that he could die in the event of a corona infection. Isolating oneself from other people is not enough, according to the 73-year-old. He does it himself as best he can. However, his wife is a primary school teacher and therefore has many contacts. That is why the Oldenburger prefers to be vaccinated or not to be given secondary treatment.

Country can comment until Monday
So far, health risk factors alone are not a reason to get the vaccine administered faster. First it is the turn of residents and employees of nursing homes, then people over 80 years of age. Because the state of Lower Saxony implements this regulation of the federal government, it is the opposing party in this legal dispute. The state can comment on the application until Monday, but does not have to, as NDR 1 Lower Saxony further reports. After the deadline, the administrative judges decide.
Oldenburger may want to call OVG
If the chamber in Oldenburg agrees, this would initially have no legal advantages for other affected parties, but it could send a strong signal. If the Oldenburg lawyers reject the urgent application, the 73-year-old plaintiff wants to go to the next instance before the Higher Administrative Court in Lüneburg.
