OJK’s New Rules, Debt Collectors Make Threats and Physical Violence Can Enter General Criminal Offenses Page all

JAKARTA, KOMPAS.com – Regulation of the Financial Services Authority (BOY) Number 6/POJK.07/2022 regarding Consumer protection and the Society in the Financial Services Sector also regulates marketer and debt collector.

OJK Deputy Commissioner for Consumer Education and Protection Sarjito said, marketer are also employees of financial services business actors (PUJK) or, marketers can be called employees employed by PUJK.

“Including the financial services sector, misseling (by marketer) it’s forbidden, absolutely forbidden. If that happens, there are sanctions. Those are PUJK employees,” he said at a press conference, Friday (20/5/2022).

He added that the new protection rules also cover work debt collector. So, he said later on there was no more reason to say affair debt collector is a different matter.

“In our terms it is clear, they (debt collector) are workers for the PUJK, so they (PUJK) must be responsible. So there are provisions,” he added.

Furthermore, he said, if there was a general criminal act such as threats and physical violence, it could be categorized as a general criminal offense.

“Even though it’s not regulated by law consumer protection OJK, but he violated the provisions of the OJK as well as general criminal offenses so that he can be reported to the police,” he said.

However, he said, the reporting can be done if the PUJK is under the supervision of the OJK. If they are not under the supervision of the OJK, he continued, the public can report directly to the police.

Furthermore, he predicts that when the POJK is socialized, the number of complaints may increase. This can happen. It is a sign that people are starting to understand when their rights and obligations are violated.

“We can’t confirm whether (consumer reports) are sloping or not. However, complaints could increase because people understand when their rights and obligations are violated,” he said.

For this reason, he also advised the public to always be rational when getting offers for financial service products.

“If it’s not clear, you can ask OJK, we provide various channels, starting from telephone, Whatsapp for reconfirmation,” he concluded.

Previously, Member of the Board of Commissioners for Education and Consumer Protection at OJK, Tirta Segara, said that this POJK clarified the obligations of the principle of openness and transparency of product and service information as well as increasing the protection of consumer data and information.

“This POJK further strengthens regulations on consumer protection and the obligations of Financial Services Businesses in response to the dynamics of changes in the financial services sector,” he said in a press release Wednesday (18/4/2022).
