ALGIERS – The Minister of Justice, Keeper of the Seals, Belkacem Zeghmati affirmed Thursday in Algiers that the law did not set a specific deadline for the response to requests for obtaining Algerian nationality, with a view to conferring the competent courts have discretionary power.

Speaking at a plenary session at the Council of the Nation, devoted to oral questions, Mr. Zeghmati clarified that Algerian law “has not set a specific deadline by which the state is required to rule on this matter. type of requests in order to confer discretionary power on the competent courts, given the importance of this link both individually and collectively “.

To a question on the consequences of not determining a deadline for responding to requests for nationality, Mr. Zeghmati indicated that “nationality as an emotional and legal bond between the individual and the State can only be granted ‘to those who have proven their loyalty towards the country and their spiritual integration into society, “adding that the specification of the conditions and procedures for granting nationality” is one of the manifestations of the exercise of State sovereignty within the limits of its territory and its citizens”.

Algerian law has set “without ambiguity” the conditions for granting nationality to foreign nationals, he continued, noting that “nevertheless, and like what is in force in other countries , nationality is attributed according to the circumstances of the country even when all the required conditions are met “.

In this regard, the Minister of Justice recalled that Algerian legislation, in line with the changes recorded in Algerian society, granted Algerian women married to a foreigner the right to transmit their nationality of origin. The Keeper of the Seals, on this occasion, stressed that the rights and duties of foreigners established on national soil “are protected”.

In response to another question on the absence of a court in the Daïra of Ain Deheb in the wilaya of Tiaret, Mr. Zeghmati said that the creation of a court obeyed several criteria, in particular the considerable increase in the judicial activity, demographic and economic growth and the availability of human resources “.

The Daïra of Aïn Deheb with its three communes and which is judicially under the jurisdiction of Sougueur “does not meet all the criteria, apart from the unavailability of necessary financial means”.

Stressing, however, that “the modernization of the sector and bringing justice closer to the citizen remain among the major priorities”, the Minister indicated that the capacities of the State “are no longer what they were 20 years ago and there are priorities to be taken into account in public spending “.
