Nicolás presents a project that seeks to regulate blood donation

San José, Feb 25 (elmundo.cr) –The liberationist deputy Franggi Nicolás presented this Wednesday file 22,413, National Blood Law.

“It hurts more to get to need blood, than to donate it!”, Said the deputy.

Nicolás pointed out that this Wednesday he approached to donate blood and told his testimony to motivate people to donate, “it was a super fast donation, less than 15 minutes, safe and without any problem.”

«Donating blood is giving life, it is an act of solidarity and love of neighbor, which needs help to survive. Unfortunately, however, voluntary donations have dropped considerably, “he added.

The deputy affirmed that “in our country there is much to do in this matter”, for which she presented the project “that seeks to provide the country with a” National Blood Law “, as we currently do not have one in this matter, which encourages donation, which strengthens the system for the safe collection and handling of blood, which allows better quality care to donors / users and which encourages institutions such as the MEP and the Ministry of Health to promote educational programs for blood donation ».

“This project is a tribute to each donor and to those who work every day saving lives,” he added.

The legislator concluded by inviting everyone “to create the habit of donating blood, just one bag can save up to 4 lives.”

About the project

File 22,413, National Blood Law, Its objective is to regulate the process of donation and use of blood or its blood components, which must respect the fundamental rights of the person, the ethical principles that come from the recognition of human dignity and the principles of justice and solidarity.

In addition, it seeks to declare of public order and of national interest the timely availability of safe blood and that the State promote the practice of voluntary, altruistic and habitual donation of safe blood as one of the mechanisms guaranteeing the protection and safety of life and of health to guarantee their access in conditions of equity and dignity.

Similarly, obtaining human blood and its components must be carried out under the supervision of a blood bank and this establishment must exercise control over the quality and the processes applied, in order to ensure the safety of blood and its derivatives, in compliance with all applicable legislation, especially the General Health Law No. 5355 of October 30, 1973 and the General Law on HIV-AIDS No. 7771 of April 29, April 13, 1998.

Likewise, it seeks to create the National Blood System that will be governed under the leadership of the Ministry of Health and will be made up of:

  • The Ministry of Health.
  • The Costa Rican Social Security Fund through the National Blood Bank and hospital services.
  • The private sector that, in the health area, has the respective authorization to provide this service.

The Ministry of Health will be the authority responsible for ensuring compliance with this law in all public and private establishments, seeking to guarantee the preservation of the health of donors, the maximum protection of recipients and health personnel. For this, it will promulgate, under the protection of this law, the regulations, guidelines and protocols that it deems necessary to guarantee its proper functioning.
