New York woman received more than $400,000 after suing police for injuring her during an arrest

A Manhattan woman was awarded more than $400,000 by a federal jury on Friday after suing New York City and its police department..

The woman said she suffered a traumatic brain injury when she was pinned to the ground by a police sergeant while she was working as a medic for protesters during a 2012 protest on Wall Street.

Mary Tardif, 33, was awarded $431,250 nearly a decade after filing a lawsuit in 2013. Tardif sought unspecified damages for injuries she suffered as a medic for protesters.

According to ABC, in an interview, Tardif called the verdict “very vindictive. I feel like I have truly met justice for the first time.”

He also added: “It feels like a victory for all of us. I wish I could share it with them. there were so many“he said, referring to other people who were injured at rallies.

On the other hand, Nick Paolucci, a spokesman for the New York City Law Department, said the city was disappointed with this result.

He noted that a jury in 2018 had rejected the claims before the United States Court of Appeals for the Second Circuit in Manhattan reinstated the case, citing flaws in the first trial.

Paolucci said that Tardif was never thrown to the ground, as she claimed. In addition, she said that the jury was unaware that the plaintiff had presented new injuries in this second trial that were never alleged in the initial case.

According to the trial evidence and Tardif’s statements, during the woman’s violent encounter with the police, her head hit the ground with such force that she sustained permanent brain damage. The woman said this injury left her unable to work and she is now in a job where she has flexible hours and where she can call in sick when she is completely immobile.
