In order to publicize the achievements and challenges of the Labor Directorate, the national director, Pablo Zenteno Muñoz, presented the Participatory Public Account 2023-2024 in the O’Higgins region, an event that was attended by regional authorities. and local, as well as union organizations in the production areas of the region.
The welcoming words were given by the regional governor, Pablo Silva Amaya, who highlighted that O’Higgins is a region that has a fairly strong union leadership for many years and that they have made history, emphasizing that the nationalization of copper is one of the most important landmarks of the country.
At this event held in the auditorium of the University of O’Higgins, the Government Seremi, Carlos Carrasco Olea, was also present; Seremi del Trabajo, Jaime Chamorro; Seremi de la Mujer, Constanza Valencia Sepúlveda; regional director of Labor, Gabriela Cabrera Pérez, among other authorities in the region.
Regarding the 2023 management and the challenge that is looming for this year 2024 of its centenary, Pablo Zenteno Muñoz indicated that the work of this institution is inserted as one of the core services when it comes to implementing, encouraging and promoting regulatory changes; And in that sense, the government of President Gabriel Boric has promoted 22 important labor modifications, whose main axes are aimed at promoting the guarantee of decent work, he assured.
Among the main modifications of the law that he mentioned, the 40-hour Law, gradual increase in the minimum wage, Karim Law, ratification of ILO Convention 190, Conciliation Law, among others.
The director of Labor clarified that these 22 important laws “will guide the future of our own institutional role.”
Referring to the 2023 Public Account, the director stated that, “our first official Public Account, strictly speaking, we are going to set some clear goals to effectively measure whether we can be contributors to the basis of the guarantee of decent work in that management.”
He indicated that they proposed goals in this centenary year, “to be stronger, to have more institutional presence in these 100 years, to strengthen labor relations and social dialogue.”
He also explained that, in the field of strengthening labor relations and social dialogue, one of the axes and strategic areas of its services are the Tripartite Regional and User Councils (CTRU), where at the national level they managed to carry out more than 124 activities that worked in 2023.
Art. 22 and the 40 Hour Law
Referring to Article 22 of the Labor Law, he expressed that they are in a constant effort to know who are the workers and companies that in our country are using article 22, “that has been a very complex effort, which has required coordination with other public institutions, and, therefore, we are going to move forward, because we want the 40-hour Law to be fulfilled.”
He said that the 40 Hour Law introduced some modifications linked to Article 22, paragraph 2, which establishes the hypotheses where there are workers who are excluded from the working day, which were reduced, and that there are two current hypotheses, which are managers, directors with administrative powers and those who work without immediate superior supervision, due to the nature of their functions.
“This is a process that obviously has to allow us to limit the range of workers who do not have a working day, because the 40 Hour Law aims to reduce the working day, but also for the greatest number of workers to know what their working day is. And what happened with this article was that there was no certainty,” he clarified.
It recognizes that there is a controversy in this matter, because they have information from the Department of Studies, which are the sectors, companies and places where Article 22 is concerned, so they are reviewing said information to see if the companies are actually leaving. adapting the hypotheses in a good way.
He highlighted that the presence of authorities, leaders, academics and company representatives in the auditorium of the University of O’Higgins (UOH) will continue to be key to compliance with good practices of labor rights at work and to build a fairer society.
